ORDINANCE NO. 101-83 <br /> <br />BY: Brown, CHtnnock, Gallagher, Graham, <br /> ~Brtde, Salmon, Wendltng <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 128.0316 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood to redefine resident to <br />exclude full time college students not residing within the City over a <br />specified period of time. <br /> <br /> WHEREAS, full time college students who do not live at their residence <br />in Lakewood on a continuous basis wht~e ~:ending college have minimal contact <br />with the City during said educational p;rtod, and <br /> <br /> . W~EREAS, full time college student~ living outside of the City do not <br />in fact uerlve substant.ial benefit from the City services available to residents <br />of the City, and <br /> <br /> WHEREAS, this Council determines that it is inequitable for full time <br /> college students residing outside of the City to be required ~o pay municipal <br /> income tax and said students shoul.~w~n fact be exempt therefrom, and <br /> <br /> WNEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public welfare and the usual daily <br />operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 128.0316 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> 128.o316 R OENT. <br /> "Resident" means an individual domiciled in the Ctt~ of Lakewood. <br />shall be and the same is hereby amended to read a~ follows: <br /> <br /> 128.0316 RESIDENT. <br /> <br /> "Resident" means an individual domiciled in the City of Lakewood <br /> but shall not include those individuals attending an accredited <br /> college or university on a full time basis who reside within the <br /> City sixteen (161 weeks or less during the taxable ye)r. <br /> <br /> section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that ali such deliberations of <br />this Council and of any of its committees that resulted in such formal action <br />were in meetings open to the public, in compliance with ali legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof'and provided .it receives <br />the affirmative vote of two-thirds of all members elected to Council. it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take.effect and be in force after the earliest <br />period allowed by law. <br /> <br />Adopted: <br /> <br /> <br />
