ORDINANCE NO: 102-83 <br /> <br />BY: Brown, Chinnock, Gallaghet <br /> Graham, McBride, Salmon <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer to <br />advertise for bids and enter into a contract with the lowest and <br />best bidder after advertisement according to law for the rehabili- <br />tation of the Sloane Avenue Underpass. <br /> <br /> WHEREAS, Council has determined that the existing sidewalk <br />and outer north retaining wall are badly deteriorated and in urgent <br />need of rehabilitation and stabilization, and <br /> <br /> I~THEREAS, this Council has authorized the preparation of con- <br />struction drawings and specifications by the Lakewood Engineering <br />Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings and <br />specifications are now on file in the City Engineer's office, and <br /> <br /> I~EREAS, this Ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department <br />and for the immediate preservation of the public safety and welfare; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the City Engineer be and he is hereby <br />authorized and directed to advertise for bids and enter into a <br />contract with the lowest and best bidder after advertisement <br />according to law for the rehabilitation of the Sloane Avenue <br />Underpass. <br /> <br /> Section 2. That the cost of such construction, <br />contingencies, is estimated at $80,000 which funds are <br />available from the Capital Improvement Fund. <br /> <br />including <br />to be made <br /> <br /> Section 3. That this Ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor; otherwise <br />it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />Clerk <br /> <br /> <br />
