ORDINANCE NO: 102-83 BY: Brown, Chinnock, Gallaghet Graham, McBride, Salmon AN EMERGENCY ORDINANCE authorizing the City Engineer to advertise for bids and enter into a contract with the lowest and best bidder after advertisement according to law for the rehabili- tation of the Sloane Avenue Underpass. WHEREAS, Council has determined that the existing sidewalk and outer north retaining wall are badly deteriorated and in urgent need of rehabilitation and stabilization, and I~THEREAS, this Council has authorized the preparation of con- struction drawings and specifications by the Lakewood Engineering Department, and WHEREAS, the aforementioned construction drawings and specifications are now on file in the City Engineer's office, and I~EREAS, this Ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the immediate preservation of the public safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the City Engineer be and he is hereby authorized and directed to advertise for bids and enter into a contract with the lowest and best bidder after advertisement according to law for the rehabilitation of the Sloane Avenue Underpass. Section 2. That the cost of such construction, contingencies, is estimated at $80,000 which funds are available from the Capital Improvement Fund. including to be made Section 3. That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force after the earliest period allowed by law.
