ORDINANCE 115-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> An Emergency Ordinance to amend Section 1 of Ordinance 113-83 to <br />provide Council the right to approve the awarding of the contract or contracts <br />for the rehabilitation of the Lakewood Park Breakwall. <br /> <br /> WHEREAS, on November 21, 1983, Council adopted Ordinance 113-83 authoriz- <br />ing the City Engineer to advertise for bids and enter into a contract with the <br />lowest and best bidder after advertisement according to law for the rehabilitation <br />of the Lakewood Park Breakwall, and <br /> <br /> WHEREAS, Council determines that it is in the best interest of the City <br />tO subject the awarding of the contract or contracts to the approval of Council, <br />and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1 of the Ordinance 113-83 adopted by the <br />Council on November 21, 1983, now reading as follows: <br /> <br />That the City Engineer be and he is hereby authorized and directed <br />to advertise for bids and enter into a contract with the lowest and <br />best bidder after advertisement according to law for the rehabilitation <br />of the Uakewood Park Breakwall. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />That the City Engineer be and he is hereby authorized and directed <br />to advertise for bids and enter into a contract with the lowest and <br />best bidder after advertisement according to law and subject to the <br />approval of Council for the rehabilitation of the Lakewood Park <br />Breakwall; provided, however, that regardless of the approval or <br />disapproval of Council as to the details of said rehabilitation, <br />the City Engineer is authorized to enter into such contract to <br />rebuild the Lakewood Park Breakwall and if sufficient funds are <br />available therefore, for fishing access installations. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal action were <br />in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-third of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force after the earliest <br />period allowed by law, and existing Section i of Ordinance 113-83 shall be and <br />the same is hereby repealed at such time. <br /> <br />Adopted: ~/~./ /f~-~ <br /> <br />Approved: <br /> <br /> <br />
