<br /> I <br />RITA shall be liable for the loss or destruction of Lakewood's data if <br />such loss or destruction was the fault of RITA's cmployees or agents. <br />Such liability is specifically limited to RITA providing Lakewood, at no <br />charge to Lakewood, with a data filc comprised of the most currcnt <br />available information. In the event that the System should be de- <br />stroyed, RITA will apply all of the necessary procedures provided by <br />Xerox to recover the System from the backup copy of the System. RITA <br />shall initiate and maintain a disaster recovery system. Lakewood shall <br />have the right upon reasonable notice to review RITA's disaster recovery <br />procedures. If cost feasible, RITA shall provide an audit, by an in- <br />dependent firm, of all internal data processing controls. <br /> 9. RITA has the right to provide the services of the System <br />to other municipalities or entities as provided in the Xerox Agreement. <br />RITA further has the right and exclusive authority to determine which <br />municipalities or entities will be so served. Lakewood has no right to <br />dictate or influence RITA's use of the System in any way, except that <br />RITA may not violate the terms of the Xerox Agreement.
