(d) No person whose operator's or chauffeur's license or permit or non- <br />resident operating privilege has been suspended under Ohio R. C, 4511. 191 <br />(Implied Consent Law) shall operate a motor v_ehicle upon thc highways or streets <br />in thc Municipality, (ORC 4511. 192) <br /> <br /> (e) It is an af£irmativc defense to any prosecution brought pursuant to this <br /> section that the alleged offender drove under suspension because of a substantial <br /> emergency, provided that no other person was reasonably available to drive in <br /> · 'o~nonse to the emergency. (CRC 4507.38; 4507.39, 4511.192) <br /> <br /> Section 3. That Chapter 333 of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood shall be supplemented by enacting new Section <br />333.021 to read as follo~vs: <br /> <br /> 333.02l OPERATION IN WILLFUL O12 WANTON DISREGARD OF SAFETY. <br /> (a) No person shall operate a vehicle on any street or highway in willful or <br />wanton disregard of thc safety of persons or property. (ORC4511.20) <br /> <br /> (b) No person shall operate a vehicle on any public or private property <br />other than streets or highways, in willful or wanton disregard of the safety of <br />persons or property. <br /> This subsection does not apply to the competitive operation of vehicles on <br />public or private property when the owner of such property 'knowingly permits such <br />operatioh thereon. (CRC 4511.201) <br /> <br /> Section 4. That SeCtion 331.34(a) of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood now reading as follows: <br /> <br />331o34 FAILURE TO CONTROL; WEAVING; FULL TIME AND ATTENTION. <br /> <br />(a) No person shall operate a motor vehicle or motorcycle upon <br />any street or highway without exercising reasonable and ordinary <br />control over such vehicle. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />331.34 FAILURE TO CONTROL; WEAVING; FULL TIME AND ATTENTION. <br /> <br /> (a) No person shall operate a motor vehicle or motorcycle on <br /> any street, highway, or property open to the public for vehicular <br /> traffic without being in reasonable control of the vehicle. <br /> (ORC 4511.202) <br /> Section 5. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this~Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 6. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council and ap- <br />proval by the Mayor, it shall take effect and be in force as of March 16, 1983, <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law, and existing Sections 333.01, 331.34(a) and 335.07 shall be and the same <br />are hereby repealed at such time. <br /> <br />Approve~~/~ / <br /> <br />PRESIDENT <br /> <br /> <br />
