(d) No person whose operator's or chauffeur's license or permit or non- resident operating privilege has been suspended under Ohio R. C, 4511. 191 (Implied Consent Law) shall operate a motor v_ehicle upon thc highways or streets in thc Municipality, (ORC 4511. 192) (e) It is an af£irmativc defense to any prosecution brought pursuant to this section that the alleged offender drove under suspension because of a substantial emergency, provided that no other person was reasonably available to drive in · 'o~nonse to the emergency. (CRC 4507.38; 4507.39, 4511.192) Section 3. That Chapter 333 of the Traffic Code of the Codified Ordinances of the City of Lakewood shall be supplemented by enacting new Section 333.021 to read as follo~vs: 333.02l OPERATION IN WILLFUL O12 WANTON DISREGARD OF SAFETY. (a) No person shall operate a vehicle on any street or highway in willful or wanton disregard of thc safety of persons or property. (ORC4511.20) (b) No person shall operate a vehicle on any public or private property other than streets or highways, in willful or wanton disregard of the safety of persons or property. This subsection does not apply to the competitive operation of vehicles on public or private property when the owner of such property 'knowingly permits such operatioh thereon. (CRC 4511.201) Section 4. That SeCtion 331.34(a) of the Traffic Code of the Codified Ordinances of the City of Lakewood now reading as follows: 331o34 FAILURE TO CONTROL; WEAVING; FULL TIME AND ATTENTION. (a) No person shall operate a motor vehicle or motorcycle upon any street or highway without exercising reasonable and ordinary control over such vehicle. shall be and the same is hereby amended to read as follows: 331.34 FAILURE TO CONTROL; WEAVING; FULL TIME AND ATTENTION. (a) No person shall operate a motor vehicle or motorcycle on any street, highway, or property open to the public for vehicular traffic without being in reasonable control of the vehicle. (ORC 4511.202) Section 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this~Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 6. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council and ap- proval by the Mayor, it shall take effect and be in force as of March 16, 1983, otherwise it shall take effect and be in force after the earliest period allowed by law, and existing Sections 333.01, 331.34(a) and 335.07 shall be and the same are hereby repealed at such time.
