ORDINANCE NO. 16-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to supplement S~ction 1301.04 of the Regional <br />Dwelling House Code of the Codified Ordinances of the City of Lakewood in order <br />to amend and enact certain sections of the Regional Dwelling House Code. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1301.04 of the Regional Dwelling House Code <br />of the Building Code of the Codified Ordinances of the City of Lakewood be <br />supplemented by amending certain sections of the Regional Dwelling House Code as <br />follows: <br /> <br />RDH 1523.02 Surface Drainage (Amended) <br /> <br /> Positive drainage shall be provided for each lot or plot by proper <br />draining so that a nuisance will not be created. Catch basins or properly <br />connected under-drains shall be installed, or other approved provisions made <br />where water may pocket, to preclude the accumulation of surface water. <br />Regrading shall be done so that existing natural ground drainage of the <br />surrounding area shall not be impeded. <br /> <br /> The Building Official or City Engineer may adopt rules or plans for <br />the drainage of lots or plots which rules or plans shall be followed by the <br />owner unless permission for deviation is given by the Board of Building Code <br />Appeals. When a lot or plot is graded to a higher or lower level than the <br />natural grade on an adjacent property, the owner of such lot or plot shall <br />provide suitable slopes or retaining walls or other protection approved by the <br />Building Official or the City Engineer on his own property to preserve the <br />natural slope or surface elevation of such adjacent property. <br /> <br />RDH 1523.05 Roof and Yard Drainage (Amended) <br /> <br /> Unless otherwise specifically approved by the Building Official or <br />City Engineer, roof drainage shall be handled by suitable collectors and <br />downspouts which shall discharge into a sealed jointed storm drain of not less <br />than 4-inch diameter with a slope of ~ inch or more per foot. Where storm sewer <br />or other storm drainage outlet is not available, or unless otherwise specifically <br />approved by the City Engineer, downspouts may discharge onto splash pads or into <br />other devices provided a nuisance is not created to adjoining property. The <br />storm drain outlet, carrying roof water or yard drainage shall be not less than <br />6-inch diameter, and shall not connect to the footing drain, but may intercept <br />and receive the outlet of the footing drain by a wye connection above the spring <br />line. Connection of any pipe, carrying roof water or yard drainage, to a <br />sanitary sewer is prohibited. <br /> <br />RDH 1593.65(b) Storm Drainage (Amended) <br /> <br /> (b) Drained to other than storm sewer. Where in the opinion of the <br />Building Official or City Engineer, no sewer is available or the overland flow <br />of stormwater does not provide a nuisance to adjoining property, the storm <br />drainage, from sources described in subsection (a) of this Section, shall be <br />piped to discharge into the street gutter, or into a receptable, or conducted to <br />other point of disposal as approved by the Building Official or the City <br />Engineers. <br /> <br /> <br />
