AN EMERGENCY ORDINANCE approving payment in an amount not to exceed <br />Four Thousand ($4.000) Dollars to property owners of the City of Lakewood for <br />costs involved in the disconnection of downspouts and/or the reconnection of <br />storm drains into the storm sewers as a moral obligation a;ld appropriating Sixty <br />Thousand ($60,000) Dollars to cover the costs of said disconnection and/or <br />reconnect~on for the calendar year 1983. <br /> <br /> WHEREAS, it has been determined that there are certain properties <br />which have storm drains presently draining into the sanitary sewer system of the <br />City, and <br /> <br /> WHEREAS, the City Engineer has determined that the present connections <br />could cause serious overloading of sanitary sewers, and <br /> <br /> WHEREAS, the City Engineer has determined that it is beneficial to the <br />City of Lakewood and its residents to disconnect said drains from the sanitary <br />sewers and reconnect to the storm sewers, and <br /> <br /> WHEREAS, recent amendments to the Regional Dwelling House Code of the <br />City of Lakewood, the Streets and Public Services Code of the City of Lakewood, <br />and the Housing lode of the City of Lakewood, permit the disconnection of <br />downspouts which ~'ow into the sanitary sewer, and <br /> <br /> WHEREAS, in order to encourage the disconnection of such downspouts <br />and the reconnect~on of storm drains into the storm sewer, this Council <br />determines it to be in the best interest of the City to pay to homeowners as a <br />moral claim an a~ount not to exceed Four Thousand ($4,000) Dollars to perform <br />such disconnection or reconnection as hereinabove noted, and <br /> <br /> WHEREAS, the City will receive a portion of the benefit of such <br />disconnection or reconnectlon so that in good conscience and according to <br />natural justice, .he City should pay the cost thereof in an amount not to exceed <br />Four Thousand ($4,000) Dollars, and <br /> <br /> WHEREAS~ this ordinance constitutes an emergency measure providing for <br />the usual dally operation of a munlc~pal department and f~rther that it is immed- <br />iately necessary to make provisions for the diversion of storm water from the <br />sanitary sewer system to the storm sewer system for the immediate preservation <br />of the public health, safety, and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is the finding of this Council that present <br />connections of storm drains flowing into sanitary sewers could cause serious <br />overloading of said sanitary sewers. <br /> <br /> Section 2. That because the potential problem exists the City <br />Engineer of the City of Lakewood is hereby authorized and directed to order, <br />where in his opinion he deems it necessary, disconnection of downspouts and/or <br />the reconnection of storm drains into storm sewers. <br /> <br /> Section 3. That this Council finds as follows: That at the time of <br />the completion of the construction of certain homes, storm drains were connected <br />to the sanitary sewer system instead of storm .sewers; that the present owners <br />will suffer economic loss then so ordered to disconnect and reconnect; that the <br />City and its residents will receive the benefits of the disconnection of said <br />drains from the sanitary sewers and that in the best interest of the City and <br />its residents, and in good conscience and according to natural justice, a moral <br />obligation exists upon the City to those owners who are so ordered by the City <br />Engineer to do those acts. <br /> <br /> <br />
