ORDINANCE NO. 30-83 BY: Brown, CHinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement with Ohio Council 8 and Local 1043 of the American Federation of State, County and Municipal Employees AFL-CIO establishing conditions of employment, working conditions and various benefits for certain employees of the Department of Publi~ Works of the City of Lakewood and authorizing the Mayor to sign said Agreement on behalf of the City. WHEREAS, a prior Collective Bargaining Agreement entered into between the City of Lakewood and Ohio Council 8 and Local 1043 of the American Federation of State, County and Municipal Employees AFL-CIO terminated on February 28, 1983, and WHEREAS, discussions and negotiations have been continued subsequent on behalf of the City with representatives of Local Union 1043 and Ohio Council 8 wit!h respect to conditions of employment, working conditions, and various bene- fits for certain employees of the Department of Public Works of the City of Lakew~od, and WHEREAS, agreement has been reached in the course of said discussions and negotiations with respect to the conditions of employment, working conditions and various benefits for certain employees aforementioned, and WHEREAS, this Council determines that it is in the best interest of the Clity to approve said Collective Bargaining Agreement and authorize the Mayor to sign same on behalf of the City, and WHEREAS, this ordinance constitutes an emergency measure providing for the ilmmediate preservation of the public health, safety and welfare and for the usuall daily operation of a municipal department, and for the further reason that it is necessary to approve said Agreement at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Collective Bargaining Agreement with Ohio Council 8 and Local 1043 of the American Federation of State, County and Municipal Employees AFL-CIO, and effective for the period of March l, 1983, to February 28, 1285, an original copy of which is on file in the Office of the Mayor of the City of Lakewood and is made a part hereof as though written fully herein, is hereby adopted, ratified and approved and the Mayor is hereby authorized and directed for and on behalf of the City of Lakewood to affix his signature thereto. Section 2. That all other ordinances or resolutions or parts of ordinances or resolutions which are inconsistent with the provisions of this ordinance and/or the Collective Bargaining Agreement made a part hereof, are hereby repealed as of March l, 1983, to the extent that they pertain to the employees in the bargaining unit covered by the Collective Bar§aining Agreement and are inconsistent with this ordinance, including the Collective Bargaining Agreement referred to herein and made a part hereof. Section 3. It is found and determined' that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an o~en meeting of this Council and that all such deliberations of this Council and any of its committees that resulted in such formal action were in meetings held in complianCe with all legal requirements, includin§ Section 121.22 of the Ohio Revised Code.
