Section 5. That traffic control signals will not be installed on the <br />project without prior approval by the Department of Transportation, State of <br />Ohio, and the City of Lakewood will place and maintain all traffic control <br />signals conforming to the Ohio Manual of Uniform Traffic Control Devices on <br />the improvement in compliance with the provisions of Section 4511.11 and re- <br />lated sections of the Ohio Revised Code. <br /> <br />Section 6, Right-of-way, utility rearrangement: <br /> <br />(b) <br /> <br />(c) <br /> <br />That all existing street and public right-of-way within <br />the Municipality which is necessary for the aforesaid <br />improvement, shall be made available therefor. <br /> <br />That any traffic signalization upgrading, relocation of <br />publically owned utilities or waterline work made nec- <br />essary by the improvement will be included in the pro- <br />ject but that the City of Lakewood will cause to be made, <br />at no expense to the Department of Transportation, State <br />of Ohio, all changes, alterations or repairs to all private <br />or public utilities which are not made necessary by the <br />improvement. <br /> <br />That the construction, reconstruction, and/or rearrangements <br />of both publically and privately owned utilities, referred <br />to in subsection (b) above, shall be done in such a manner <br />as not to interfere unduly with the operation of the con- <br />tractor constructing the improvement, and all backfilling <br />of trenches and made necessary by such utility rearrange- <br />ment shall be performed in accordance with the provision <br />of'the Department of Transportation, State of Ohio Con- <br />struction and Material Sepcifications. <br /> <br /> Section 7. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 8. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Appr°ved ~/~9~'~ %/7/ !~°°'~-~ <br /> <br /> <br />
