$ <br /> <br />719.141 AMUSEMENT DEVICES PERMIT-CERTAIN LIQUOR ESTABLISHMENTS <br /> <br />(a) Businesses and/or premises licensed by the Ohio Department of <br />Liquor Control of the State of Ohio for on-premises consumption of <br />alcoholic beverages wherein the annual gross revenues generated from <br />the operation of amusement devices is no greater than 25% (twenty- <br />five percent) of the annual gross revenue for such business or pre- <br />mises shall be required to obtain a permit for each coin operated <br />machine operated on the premises. <br /> <br />(b) Applications for such permits shall be made to the Building <br />Commissioner and shall be on forms prescribed and furnished by the <br />City. Such applications shall include the name, and address of the <br />applicant, the place where such amusement device is to be installed, <br />displayed, operated or maintained, and the nature of the business <br />conducted at that place, the total number of such amusement devices <br />to be displayed, installed, operated or maintained, the description <br />of each including the serial numbers of each such device and such <br />other and further information as may be required by the City. <br /> <br />{c) Each applicant shall be charged with the duty of reporting any <br />newly installed amusement device or any substitutions made during <br />the permit period. <br /> <br />(d) The permit provided for herein shall cover the period from May <br />1st through April 30th of each year unless otherwise earlier suspended <br />or revoked. <br /> <br />(e) The fee for each amusement device permit provided for herein <br />shall be Twenty-Five ($25.00) Dollars per year or any portion there- <br />of. <br /> <br /> Section 4. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Adopted: ~.~ ~-i <br /> <br />~LERK '~ <br /> <br />Approved: <br /> <br /> <br />
