for in Section 1 hereof from the Hospital Fund upon delivery by the <br />Grantor of a good and sufficient Warranty Deed to the City of Lakewood, <br />together with guarantee of title disclosing the said real estate to be <br />free and clear of all encumbrances excepting taxes and assessments not <br />yet due and payable, zoning ordinances and restrictions of record, if <br />any; and that the Director of Finance be and he is hereby authorized to <br />pay the City's share of expenses incidental to the completion of the <br />purchase, including the cost of the Deed, one-half of the escrow fee and <br />any prorata share chargeable to the City as purchaser. <br /> <br /> Section 3. The cost of the purchase of said property shall be paid <br />from the Hospital fund - plant replacement restricted fund. <br /> <br /> Section 4. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all said <br />deliberations of this Council and t~at of any of its committees that <br />resulted in such formal action, were in meetings open to the public in <br />accordance with all legal requirements including Section 121.22 of the <br />Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it re- <br />ceives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor, otherwise it shall take effect and be in force <br />from and after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Approved/~/~/2~'~_~ <br /> <br />-2- <br /> <br /> <br />
