ORDINANCE NO. 65-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE requesting the issuance of bonds of the State <br />of Ohio pursuant to Article VIII, Section 13 of the Ohio Constitution and <br />Chapter 165 of the Ohio Revised Code, to finance a commercial facility within <br />the boundaries of the City for the Marlowe, an Ohio Limited Partnership. <br /> <br /> WHEREAS, The Marlowe, an Ohio limited partnership has proposed to <br />acquire, construct, and equip a commercial supportive care facility, all of <br />which is to be located in this City, provided that the State of Ohio makes <br />available the financing for acquisition, construction and equipping of such <br />facility by the issuance of its revenue bonds pursuant to the authority of <br />Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio <br />Revised Code. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the further reason that this ordinance must be immediately effective in <br />order to permit the aforesaid Bonds to be authorized and facilities to be <br />acquired and improved at the earliest possible time, thereby creating and <br />preserving the jobs and employment opportunities and improving the economic <br />welfare of the people of the City; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this City hereby requests in writing the Ohio Develop- <br />ment Financing Commission, acting on behalf of the State of Ohio, to issue <br />revenue bonds of the State pursuant to the authority of Article VIII, Section <br />13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code, for the <br />purpose of financing the acquisition and improvement of the above-mentioned <br />facility and acknowledges that as stated in the preamble of this ordinance it <br />is to be located within the boundaries of this City. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br />and directed to forward a certified copy of this ordinance to the Ohio Develop- <br />ment Financing Commission, which certified copy of this ordinance shall be the <br />written request called for by division (C) of Section 165.03 of the Ohio <br />Revised Code. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the adoption of this ordinance were adopted <br />in an open meeting of this Council, and that all deliberations of this Council <br />and any of its committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements inclucing Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Adopted: <br /> <br />Approved.'~ ~ /~ <br /> <br /> <br />
