65-83 Request bonds to finance commercial facility

ORDINANCE NO. 65-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE requesting the issuance of bonds of the State of Ohio pursuant to Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code, to finance a commercial facility within the boundaries of the City for the Marlowe, an Ohio Limited Partnership. WHEREAS, The Marlowe, an Ohio limited partnership has proposed to acquire, construct, and equip a commercial supportive care facility, all of which is to be located in this City, provided that the State of Ohio makes available the financing for acquisition, construction and equipping of such facility by the issuance of its revenue bonds pursuant to the authority of Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare, and for the further reason that this ordinance must be immediately effective in order to permit the aforesaid Bonds to be authorized and facilities to be acquired and improved at the earliest possible time, thereby creating and preserving the jobs and employment opportunities and improving the economic welfare of the people of the City; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this City hereby requests in writing the Ohio Develop- ment Financing Commission, acting on behalf of the State of Ohio, to issue revenue bonds of the State pursuant to the authority of Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code, for the purpose of financing the acquisition and improvement of the above-mentioned facility and acknowledges that as stated in the preamble of this ordinance it is to be located within the boundaries of this City. Section 2. That the Clerk of Council be and she is hereby authorized and directed to forward a certified copy of this ordinance to the Ohio Develop- ment Financing Commission, which certified copy of this ordinance shall be the written request called for by division (C) of Section 165.03 of the Ohio Revised Code. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements inclucing Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force after the earliest period allowed by law.
