ORDINANCE N0.78-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Wendling AN EMERGENCY ORDINANCE to amend Section 903.03 of the Streets, Util- ities and Public Services Code of the Codified Ordinances of the City of Lake- wood relating to sidewalk widths. WHEREAS, trees within the public right of way often make it impractical or impossible to construct sidewalks in accordance with prescribed sidewalk widths, and WHEREAS, under said circumstances, it is in the best interest of the City that the sidewalk be constructed under the direction of and to the accep- tance of the Director of Public Works, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section Services Code of as follows: 1. That Section 903.03 of the Streets, Utilities the Codified Ordinances of the City of Lakewood, and Public now reading 903.03 SIDEWALK WIDTHS. On all streets and alleys of not less than thirty-three or more than forty feet in width, the sidewalks shall not be less than four feet wide. On all streets not less than forty nor more than sixty feet in width, all sidewalks shall be not less than five feet wide. On all streets more than sixty feet wide and on all main streets or east and west thoroughfares, except Clifton Boule- vard, all sidewalks shall be not less than six feet wide. However, on any street which is not a main street or an east west thoroughfare, but is nevertheless devoted entirely to residences, the sidewalks shall be not less than five feet wide. On Clifton Boulevard, all sidewalks shall be not less than five feet wide. shall be and the same is hereby amended to read as follows: 903.03 SIDEWALK WIDTHS.
