ORDINANCE NO. 80-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City of <br />Lakewood to enter into a Land Installment Contract with the Lakewood Little <br />Theatre for the sale of the north half of the Armory property known as 1437 Wayne <br />Avenue, in the City of Lakewood, which property is in the process of being pur- <br />chased by the City of Lakewood from the State of Ohio and determining that it <br />is in the best interest of the City that said property be sold. <br /> <br /> WHEREAS, the City of Lakewood is currently in the process of purchasing <br />the Lakewood Armory property from the State of Ohio, said purchase having already <br />been approved by the Ohio General Assembly and the appropriate Bill signed by <br />the Governor of the State of Ohio, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of <br />the City and its residents to expand on a more permanent basis the cultural <br />arts program of the Beck Center, and <br /> <br /> WHEREAS, such expansion can be accomplished by making available to <br />the Beck Center by purchase, the north half of said Armory property including <br />the main drill hall, but reserving to the City certain exclusive use of said <br />hall, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY I'HE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council determines that the north half of the <br />Armory property designated as 1437 Wayne Avenue in the City of Lakewood should <br />be sold and that such sale is in the best interest of the City. <br /> <br /> Section 2. That this Council determines that the north half of the <br />Armory property designated as 1437 Wayne Avenue in the City of Lakewood is not <br />needed for any municipal purpose and that the sale of the aforementioned property <br />will further the interests of this City and its residents. <br /> <br /> Section 3. That the Mayor be and he is hereby authorized and <br />directed on behalf of the City of Lakewood to enter into a Land Installment <br />Contract with the Lakewood Little Theatre for the sale of the north half of the <br />Armory property designated as 1437 Wayne Avenue in the City of Lakewood (which <br />property is more fully described in Exhibit "A" of said Land Installment <br />Contract) for the purchase price of $91,500.00, which Land Installment Contract <br />shall be substantially in the form of Exhibit "1" attached hereto and made a <br />part hereof as if fully rewritten herein. <br /> <br /> Section 4. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take ef- <br />fect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise, it shall take effect and be in force after the earliest period <br />al 1 owed by 1 aw. <br /> <br /> /z~ .... ~I~[~'DE NT ' <br /> <br /> <br />
