ORDINANCE NO. 86-83 BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of <br />Public Works to to take competitive bids without advertisement and to enter <br />into a contract for the boring and ins~tallation of pipe casing for the <br />Department of Public Works to repair the sanitary and storm sewers on Fry <br />Avenue directly beneath the railroad grade crossing. <br /> <br /> WHEREAS, it has come to the attention of the Division of Streets, De- <br />partment of Public Works that the sanitary ~nd storm sewers on Fry Avenue direct- <br />ly beneath the railroad grade crossing have caved in, and <br /> <br /> WHEREAS, temporary measures have been taken which allow sewage and <br />storm water to flow passed this point; but a potentially serious problem exists <br />should the sewer become completely blocked, and <br /> <br /> WHEREAS, it is essential that the sanitary and storm sewer referred <br />to above be repaired immediately so that homes south of the railroad tracks <br />will not be cut off from the main sewer on Clifton Boulevard, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby auth- <br />orized and directed to take competitive bids without advertising and to enter <br />into a contract for the boring and installation of pipe casing for the <br />Department of Public Works to repair the sanitary and storm sewers on Fry <br />Avenue directly beneath the railroad grade crossing. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take ef- <br />fect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />Approved:~ <br /> <br /> <br />
