any such transfer) of Bonds sufficient to reimburse <br />them for any tax, fee or other governmental charge re- <br />quired to be paid with respect to such exchange or <br />transfer, and the City and the Registrar may charge a <br />sum sufficient to reimburse them for all other costs <br />and expenses incurred in connection with such exchange, <br />and such charge or charges shall be paid before any <br />such new Bond shall be delivered." <br /> <br /> Section 4. Sections 2, 3 and 4 of the Original Note Ordinance <br />are hereby repealed. <br /> <br /> Section 5. The Clerk of Council is hereby authorized and di- <br />rected to forward a certified copy of this ordinance to the County Audi- <br />tor of Cuyahoga County. <br /> <br /> Section 6. It is found and determined that all formal actions <br />of this Council concerning andrelating to the passage of this ordinance <br />were adopted in an open meeting of this Council and that all such de- <br />liberations of this Council and any of its committees that resulted in <br />such formal action were in meetings open to the public in compliance with <br />all legal requirements· including the City's Charter and Codified Ordi- <br />nances and Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 7. This ordinance is hereby declared to he an emer- <br />gency measure necessary for the immediate preservation of the public <br />peace, property, health, safety and welfare in the City for the reasons <br />set forth and defined in the preamble to this ordinance and provided it <br />receives the affirmative vote of two-thirds (2/3) of all members elected <br />to Council, this ordinance shall take effect and he in force immediately <br />upon its passage by the Council and approval by the Mayor; otherwise, it <br />shall take effect and he in force after the earliest period allowed by <br />law. <br /> <br />Passed: <br /> <br />· 1983 <br /> <br />, 1983 <br /> <br />Clerk of Council <br /> <br />5 <br /> <br /> <br />
