ORDINANCE NO. 91-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf of the City of Lakewood to accept as a gift to the City of Lakewood a deed for a parcel of land known as 1383 Edanola Avenue in the City of Lakewood, from Bonne Bell, Inc. WHEREAS, Bonne Bell, Inc. is the owner of a parcel of vacant land approximately 40' x 131' located at 1383 Edanola Avenue in the City of Lakewood, and WHEREAS, Bonne Bell, Inc. has expressed a willingness and desire to transfer this parcel of land to the City as a gift, and WHEREAS, this Council determines that it is in the best interest of the City to accept such parcel of land, and WHEREAS, that this ordinance constitutes an emergency measure in that the acceptace of said gift should be consumated at the earliest possible time and for the immediate preservation of the public welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to accept as a gift to the City of Lakewood from Bonne Bell, Inc. a deed for the premises known as 1383 Edanola Avenue in the City of Lakewood, Ohio, and further described as follows: SITUATED in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being Sublot No. 90 in the Mathews and Gilbert Highbridge Park Subdivision No. 4 of part of Original Rockport Township Section No. 23, and shown by the recorded plat in Volume 30 of Maps, Page 10 of Cuyahoga County Records, and being 40.84 feet front on the easterly side of Sloane Avenue, and extending back 131.12 feet deep on the northerly line, 126.90 feet deep on the southerly line and having a rear line of 28.29 feet, as appears by said plat, together with all the hereditaments and appurtenances thereof, but subject to all legal hi9hways. Permanent Parcel No. 3Il-15-11. Section 2. That the Director of Law is hereby authorized and directed to cause said deed to be filed for record with the Recorder of Deeds and Records of Cuyahoga County. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emer9ency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in fOrce immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
