Exhibit "A" : <br /> <br /> SUPPLEMENTAL AGREEMENT NO. 1 · <br /> <br /> WHEREAS· an a~reement was entered into o, November 15, l=o~ be~een the <br />State of Ohio, Department of Natural Resources and the City of Lakewood, <br /> <br />12650 Detroit Avenue, Lakewood, Ohio for the construction of a breakwall <br /> <br />project to arrest shore erosion along the Lakewood Park shoreline on Lake <br /> <br />Erie in the City of Lakewood, and <br /> <br /> WHEREAS, it has been determined to expand the amount of the Project scope <br />from $726,000 to $1,650,000, an increase in the amount of $924,000, and <br /> <br /> WHEREAS, the State and the City have mutually agreed to the amount of the <br />increase in Project scope, and <br /> <br /> WHEREAS, funds in the amount of $924,000 to cover the increase in the <br />Project scope amount have been released by the Controlling Board as of <br /> <br />on <br /> <br />· 1983, encumbered by Contract Encumbrance Record Number <br /> <br />· and are so certified by the Director of Budget & Management <br /> <br /> · 1983. Obligations of the State are subject <br /> <br />to the provisions of Section 131.17, of the Ohio Revised Code. <br /> <br /> NOW THEREFORE, it is mutually agreed between the State of Ohio, acting by <br />and through the DireCtor, Department of Natural Resources and the City of <br /> <br />Lakewood, that the Agreement of November 15, 1982 is hereby amended as <br /> <br />follows: <br /> <br /> Revise Clause 3 to read as follows: <br /> <br /> 3) The STATE will pay to the CITY, the actual cost of the project construction, <br />not to exceed the amount of $1,650,000. Project costs shall include <br />engineering· design and .supervision costs· advertising costs· and construction <br />costs. Any work performed by CITY staff on this project shall not be <br />eligible as part of the Project cost. <br /> <br /> Revise Clause 14 to read as follows: <br /> <br /> 14) The final invoice for construction will not be approved by the STATE <br /> <br />until the project has been inspected and approved by the Chief Engineer <br /> <br />of the Department of Natural Resources. Upon final approval by the STATE of <br /> <br />the construction work, the CITY agrees to operate and maintain the project <br /> <br />thereafter, without cost to the STATE. It is mutually agreed that the total <br /> <br />project shall be completed by June 30, 1984. <br /> <br /> <br />
