ORDINANCE NO. 10-84 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend paragraph (c) of Section 741.08 of <br />the Business Regulation Code of the Codified Ordinances of the City of Lakewood <br />exempting non-profit organizations under certain conditions from the requirement <br />of the non-refundable $100 fee for the operation of a temporary store. <br /> <br /> WHEREAS, on February 7, 1983, Council enacted new Chapter 741 of the <br />Business Code of the Codified Ordinances of the City of Lakewood providing fOr <br />the licensing of peddlers, vendors and solicitors, and <br /> <br /> WHEREAS, included in the provisions of said Chapter is a non-refund- <br />able $100.00 fee for each location for the operation of a temporary store, and <br /> <br /> WHEREAS, subsequent contact with the Lakewood Chamber of Commerce and <br />affected merchants has indicated that non-profit, charitable, religious, educa- <br />tional, etc. organizations could and should be exempted from the $100.00 fee re- <br />quirement under certain circumstances, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the Public health, safety and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That paragraph (c) of Section 741.08 of the Business Regu- <br />lation Code of the Codified Ordinances of the City of Lakewood now reading as <br />follows: ' <br /> <br />741.08 TEMPORARY STORE. <br /> <br />(b). . <br />(c) 'A non-refundable $100.00 fee for each location shall <br />be paid at the time the application is made. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />741.08 TEMPORARY STORE. <br /> <br />(b) . <br />(c) 'A'non-refundable $100.00 fee for each location shall <br />be paid at the time the application is made provided, how- <br />ever, such fee may be waived by the Director of Public <br />Safety upon a showing satisfactory to the Director of <br />Public Safety that the applicant is a non-profit corpora- <br />tion qualified under Section SOl(c) of the Internal Revenue <br />Code and that the net proceeds of sales will be used for <br />community programs and projects which benefit the City of <br />Lakewood. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of-its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
