ORDINANCE NO. 10-84 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend paragraph (c) of Section 741.08 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood exempting non-profit organizations under certain conditions from the requirement of the non-refundable $100 fee for the operation of a temporary store. WHEREAS, on February 7, 1983, Council enacted new Chapter 741 of the Business Code of the Codified Ordinances of the City of Lakewood providing fOr the licensing of peddlers, vendors and solicitors, and WHEREAS, included in the provisions of said Chapter is a non-refund- able $100.00 fee for each location for the operation of a temporary store, and WHEREAS, subsequent contact with the Lakewood Chamber of Commerce and affected merchants has indicated that non-profit, charitable, religious, educa- tional, etc. organizations could and should be exempted from the $100.00 fee re- quirement under certain circumstances, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the Public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That paragraph (c) of Section 741.08 of the Business Regu- lation Code of the Codified Ordinances of the City of Lakewood now reading as follows: ' 741.08 TEMPORARY STORE. (b). . (c) 'A non-refundable $100.00 fee for each location shall be paid at the time the application is made. shall be and the same is hereby amended to read as follows: 741.08 TEMPORARY STORE. (b) . (c) 'A'non-refundable $100.00 fee for each location shall be paid at the time the application is made provided, how- ever, such fee may be waived by the Director of Public Safety upon a showing satisfactory to the Director of Public Safety that the applicant is a non-profit corpora- tion qualified under Section SOl(c) of the Internal Revenue Code and that the net proceeds of sales will be used for community programs and projects which benefit the City of Lakewood. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of-its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
