Ordinance No: 13-84 By: Brown, Chinnock, Ga).lagher, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor, on behalf of the City of Lakewood, to enter into an agreement with the Board of County Commissioners of Cuyahoga County for. the rehabilitation of the Clifton-Westlake Bridge No. 204 over the Rocky River. WHEREAS, the County of Cuyahoga and/or the Department of Transportation, State of Ohio, is considering the improvement of the public highway which is hereby described as follows: Rehabilitate Clifton-Westlake Bridge No. 204 over the Ricky River, and tCHEREAS, this Ordinance is hereby declared to be an emer- gency ordinance immediately necessary for the preservation of the public peace, health and safety, such emergency existing by reason of the present condition of said bridge and by reason of the in- adequacy of said bridge to handle existing and anticipated vehicular traffic over the Rocky River; in consequence whereof great public inconvenience is being suffered and will be suffered and public vehicular traffic endangered and delayed; and for the further reason that it is necessary to expedite the development of the plans for the rehabilitation of said bridge; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. (COnsent). That it is declared to be in the public interest that the consent of said Municipality be and such consent is hereby given to the County of Cuyahoga and/or the Depart- ment of Transportation, State of Ohio, to rehabilitate the above described bridge, in accordance with plans, specifications and estimates as approved by the County and/or the Department of Transportation, State of Ohio. Section 2. (cooperation). That said Municipality hereby proposes to cooperate with the State of Ohio, in the cost of the above described improvement as follows: (a) By the approval of application by the Board of County Commissioners for Municipal cooper- ation with the County in the cost of the im- provement project to the extent of funds re- ceived by an allocation from the County Motor Vehicle ~5 License Tax Fund. (b) There shall be no roadway participation by said Municipality for the aforesaid improve- ment other than the $5 License Tax Funds. Section 3. (Authority to Sign). That the Mayor of said Municipality is hereby authorized to enter into'maintenance and park- ing agreements and special contractual obligations. Section 4. (Maintenance and Parking). That upon completion of said improvement said Municipality will thereafter keep said bridge open to traffic at all times, and (a) Maintain the improvement in accordance with the provisions of the statutes re- lating thereto and make ample financial provisions for such maintenance.
