ORDINANCE NO. 20-84 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to engage <br />special consultants to assist in evaluating &irequest of Cox Cable Cleveland <br />Area, Inc. for an increase in its basic cable rate schedule. <br /> WHEREAS, Cox Cable Cleveland Area, Inc. has requested~an increase in <br />its basic cable rate schedule pursuant to Section g of Ordinance 34-72 as <br />amended by Ordinance 46-79, and <br /> WHEREAS, in order to properly evaluate such request, this Council <br />determines that' the employment of consultants to advise it in such matter is <br />necessary and advisable, and <br /> WHEREAS, Messers. Gary Previts and Michael J. Zofchak, 16516 Timber- <br /> line Drive, Strongsville, Ohio, 44136, have been examined and found adequate <br /> and satisfactory to discharge such task, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the immediate preservation of the publi~ welfare and for the further reason <br /> that such consultants should be retained at the earliest possible time; now, <br /> therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor be and he is hereby authorized and <br /> directed to engage Messers. Gary Previts and Michael J. Zofchak, 16516 Timber- <br /> line Drive, Strongsville, Ohio, 44136, as consultants to assist in evaluating a <br /> request from Cox Cable Cleveland Area, Inc. for an increase in its basis cable <br /> rate schedule. <br /> Section 2. That the fees for such consultant shall not exceed the <br /> sum of Four Thousand ($4,000) Dollars and shall be paid from the General <br /> Fund. : <br /> Section 3. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this ordinance were <br /> adopted in an open meeting of this Council, and that all such deliberations of <br /> this Council and of any of its committees that resulted in such formal action <br /> were in meetings open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> Section 4. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members elected to Council, it shall <br /> take effect and be in force immediately upon its adoption and approval by the <br /> Mayor; otherwise, it shall take effect and be in force after the earliest <br /> period allowed by law. <br /> <br />Approved ~~>~ J~.F '~J~ <br /> <br /> <br />
