C~~ NO. 23-84 ~: Brown, Chinno~k, Gallagher, Graham, McBride, Salmon, Wendling AN ~~ ORDINANCE to SUl~lement Section 1303.04 of the Regi~ Building Code of the Oodified Ordinance of the City of T~kewood in order to amend, repeal or enact certain l~rovisicns of the Regional Building Code. WHEREAS, the National Standards are u~x~ated and amended from time to time due to new products and changing construction techniques, and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare and for the usual daily operation of a municipal department; now, therefore, Section 1. ~nat Section 1303.04 of the Begi~nal Building Code of the Building CUde of the Codified Ordinances of the City of Lakewood be supplemented by amending Section 1607.01 of the Begional Building Code as follows: RBC 1607.01 APPLICATI(kN (AMENIF_D) Standard specificatic~s., codes and other standard requirements, rules, regulations or recommendations mentioned in this Oode, either by name or by number or by both, shall be those more fully identified by name, number and year or symbol of date of issue and as may be amended from time to time, in Chapter 7 of this Code or in Chapter 21 of the Regional Dwelling House Code. In lieu of requirements, not specifically contained in this ~ode nor in rules or regulations promulgated by authority thereof, compliance with the standards, specifications, regulations or recc~nendati~ enumerated in this Chapter may be accepted by the' Building Official as prima-facia evidence of conformity with accepted e~gineering practice. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its ccamnittees that resulted in Such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the ~hio Bevised Oode. Section 3. ~hat this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative ~ote of two-thirds of all members of (k)uncil, it shall take effect and be in force i~ediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
