ORDINANCE NO. 28-84 BY: Brown, Chinnock, Gallagher, <br /> McBride, Salmon~ Wendling <br /> <br />AN EMERGENCY ORDINANCE authorizing and directin§ the Mayor for and ~n,-.bebalf <br />of the City of Lakewood to employ by contract the firm of Laventhol & <br />Horwath, Certified Public Accountants,as financial consultants and nego- <br />tiators for the Lakewood Downtown Redevelopment Project. <br />WHEREAS, the Planning Commission has made a recommendation to the Admin- <br />istration and Council to utilize the services of a financial consultant <br />and negotiator to negotiate with the developer for the Lakewood Downtown <br />Redevelopment Project, and <br />WHEREAS, this Council determines that the firm of Laventhol & Horwath, <br />Certified Public Accountants, is qualified to perform such services <br />for the City of Lakewood and it ~s in the best interests of the City <br />that their services be retained, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br /> immediate preservation of the public health, safety, and welfare; now, <br /> therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor be and he is authorized and direCted for and <br /> on behalf of the City of Lakewood, to employ by contract the firm of <br /> Laventhol & Horwath, Certified Public Accountants, 1900 East 9th St., <br /> Cleveland, Ohio, 44114 as financial consultants and negotiators to nego- <br /> tiate with the developer of Lakewood Downtown Redevelopment Project, <br /> the fees for such services not to exceed the sum of $25,000. <br /> Section 2. That the fees for services of Laventhol & Horwath in an amount <br /> not to exceed the sum of $25,000 shall be paid from Community Development <br /> Block Grant Fund. <br /> Section 3. It is found and determined that all formal actions of this <br /> Council concerning and relating to the passage of this ordinance were <br /> adopted in an open meeting of this Council, and that all such delibera- <br /> tions of this Council and of any of its committees that resulted in such <br /> formal action were in meetings open to the public, in compliance with <br /> all legal requirements including Section 121.22 of the Ohio Revised Code. <br /> Section 4. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it <br /> receives the affirmative vote of two-thirds of all members elected to <br /> Council, it shall take effect and be in force immediately upon its adop- <br /> tion and approval by the Mayor; otherwise, it shall take effect and be <br /> in force after the earliest period allowed by law. <br /> <br /> Approved <br /> <br /> <br />
