ORDINANCE NO. 28-84 BY: Brown, Chinnock, Gallagher, McBride, Salmon~ Wendling AN EMERGENCY ORDINANCE authorizing and directin§ the Mayor for and ~n,-.bebalf of the City of Lakewood to employ by contract the firm of Laventhol & Horwath, Certified Public Accountants,as financial consultants and nego- tiators for the Lakewood Downtown Redevelopment Project. WHEREAS, the Planning Commission has made a recommendation to the Admin- istration and Council to utilize the services of a financial consultant and negotiator to negotiate with the developer for the Lakewood Downtown Redevelopment Project, and WHEREAS, this Council determines that the firm of Laventhol & Horwath, Certified Public Accountants, is qualified to perform such services for the City of Lakewood and it ~s in the best interests of the City that their services be retained, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is authorized and direCted for and on behalf of the City of Lakewood, to employ by contract the firm of Laventhol & Horwath, Certified Public Accountants, 1900 East 9th St., Cleveland, Ohio, 44114 as financial consultants and negotiators to nego- tiate with the developer of Lakewood Downtown Redevelopment Project, the fees for such services not to exceed the sum of $25,000. Section 2. That the fees for services of Laventhol & Horwath in an amount not to exceed the sum of $25,000 shall be paid from Community Development Block Grant Fund. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such delibera- tions of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adop- tion and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law. Approved
