ORDINANCE NO. 35-84 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor or his des- ignated representative for and on behalf of the City of Lakewood to participate in a Suburban Water Council of Governments. WHEREAS, on April 18, 1983, the City of Lakewood entered into a master meter water service agreement with the City of Cleveland, and WHEREAS, the judgement entry rendered in a prior lawsuit involving the City of Cleveland and the suburban communities with respect to the rights, duties and responsibilities of the parties relative to water services provided for the establishment of a Suburban Water Council of Governments, and WHEREAS, it is in the best interest of the City that the City of Lake- wpod participate in said Suburban Water Council of Governments, which Council of Governments is established to implement and participate in a method of under- standing between the City of Cleveland and the suburban communities relative to water service, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor or his designated representative be and they are hereby authorized and directed for and on behalf of the City of Lakewood to enter into an agreement with other political subdivisions and to do all other things necessary to establish and participate in a Suburban Water Council of Governments consisting of the suburban communities served by the water system owned and operated by the City of Cleveland. Said Council shall be established in accordance with the provisions of Chapter 167 of the Ohio Revised Code. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law. t~RE5 I13ENT Approved:
