ORDINANCE NO. 35-84 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor or his des- <br />ignated representative for and on behalf of the City of Lakewood to participate <br />in a Suburban Water Council of Governments. <br /> WHEREAS, on April 18, 1983, the City of Lakewood entered into a <br />master meter water service agreement with the City of Cleveland, and <br /> <br /> WHEREAS, the judgement entry rendered in a prior lawsuit involving <br />the City of Cleveland and the suburban communities with respect to the rights, <br />duties and responsibilities of the parties relative to water services provided <br />for the establishment of a Suburban Water Council of Governments, and <br /> WHEREAS, it is in the best interest of the City that the City of Lake- <br />wpod participate in said Suburban Water Council of Governments, which Council <br />of Governments is established to implement and participate in a method of under- <br />standing between the City of Cleveland and the suburban communities relative to <br />water service, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health and welfare; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor or his designated representative be and <br /> they are hereby authorized and directed for and on behalf of the City of <br /> Lakewood to enter into an agreement with other political subdivisions and to do <br /> all other things necessary to establish and participate in a Suburban Water <br /> Council of Governments consisting of the suburban communities served by the <br /> water system owned and operated by the City of Cleveland. Said Council shall <br /> be established in accordance with the provisions of Chapter 167 of the Ohio <br /> Revised Code. <br /> Section 2. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this ordinance were <br /> adopted in an open meeting of this Council, and that all such deliberations of <br /> this Council and of any of its committees that resulted in such formal action <br /> were in meetings open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members elected to Council, it shall <br /> take effect and be in force immediately upon its adoption and approval by the <br /> Mayor; otherwise, it shall take effect and be in force after the earliest <br /> period allowed by law. <br /> <br />t~RE5 I13ENT <br /> <br />Approved: <br /> <br /> <br />
