ORDINANCE NO. 37-84 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to supplement Chapter 525 of the General Offenses Code of the Codified Ordinances of the City of Lakewood, by enacting new Section 525.021 relating to the giving of false information to law enforcement officers. WHEREAS, it is an integral part of the law enforcement function to ob- tain names and identifying data from persons, and WHEREAS, persons arrested, cited, or involved in unlawful activity frequently furnish false and misleading information regarding their identity, and WHEREAS, such false information results in many needless hours of in- vestigation to relocate and identify such persons, and WHEREAS, this ordinance constitUtes an emergency measure providing for the immediate preservation of the public safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Chapter 525 of the General Offenses Code of the Codi- fied Ordinances of the City of Lakewood shall be and the same is hereby supplemented by enacting new Section 525.021 to read as follows: 525.021 GIVING FALSE INFORMATION TO LAW ENFORCEMENT OF- FICERS. (a) No person shall knowingly give or assist in giving false information relative to the name, address, or date of birth of any person to any law enforcement officer as defined in Section 2901.01(K) of the Ohio Revised Code. (b) Where contradictory information is given by the offender within the period of the statute of limitations for giving false information, it is not necessary for the prosecution to prove which information was false, but only that one or the other was false. (c) Whoever violates this section is guilty of giving false information, a misdemeanor of the first degree. Section 2. It is found and' determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
