ORDINANCE NO. 37-84 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to supplement Chapter 525 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood, by enacting <br />new Section 525.021 relating to the giving of false information to law <br />enforcement officers. <br /> <br /> WHEREAS, it is an integral part of the law enforcement function to ob- <br />tain names and identifying data from persons, and <br /> <br /> WHEREAS, persons arrested, cited, or involved in unlawful activity <br />frequently furnish false and misleading information regarding their identity, and <br /> <br /> WHEREAS, such false information results in many needless hours of in- <br />vestigation to relocate and identify such persons, and <br /> <br /> WHEREAS, this ordinance constitUtes an emergency measure providing <br />for the immediate preservation of the public safety and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Chapter 525 of the General Offenses Code of the Codi- <br />fied Ordinances of the City of Lakewood shall be and the same is hereby <br />supplemented by enacting new Section 525.021 to read as follows: <br /> <br />525.021 <br /> <br />GIVING FALSE INFORMATION TO LAW ENFORCEMENT OF- <br />FICERS. <br /> <br />(a) No person shall knowingly give or assist in giving <br />false information relative to the name, address, or date <br />of birth of any person to any law enforcement officer as <br />defined in Section 2901.01(K) of the Ohio Revised Code. <br /> <br />(b) Where contradictory information is given by the <br />offender within the period of the statute of limitations <br />for giving false information, it is not necessary for the <br />prosecution to prove which information was false, but only <br />that one or the other was false. <br /> <br />(c) Whoever violates this section is guilty of giving <br />false information, a misdemeanor of the first degree. <br /> <br /> Section 2. It is found and' determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Approved <br /> <br /> <br />
