ORDINANCE NO. 43-84 BY: Brown, Gallagher, Graham, McBride, <br /> Wendl ing <br /> <br />AN EMERGENCY ORDINANCE authorizing the Dlrector of Economic and <br />Community Development of the City of Lakewood to purchase certain <br />real estate known as P.P. No. 312-29-069 located at 1301-03 Beach <br />Avenue, in Lakewood, Ohio, hereinafter more particularly <br />described and subject to the terms and conditions hereinafter set <br />forth. <br /> <br />WHEREAS, this ordinance constitutes an emergency measure <br />providing 'for the immediate preservation of the public health and <br />welfare and for the usual daily operation of a municipal <br />department and for the further reason that the owners have agreed <br />to sell s~id property for the consideration herein stipulated <br />and this Council determines it to be in the best interest of the <br />City that the property be purchased immediately so that <br />the Clifton Prado Improvement Project can be commenced without <br />any delay; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OH I0: <br /> <br />Section 1. That the Director be and he is hereby authorized and <br />directed to purchase from Jimmy D. Wilson, Sr. and Sharon L. <br />Wilson the following property: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga <br />and State of Ohio: and known as being part of Sublot <br /> No. 68 in The Henry Beach Subdivision of part origin- <br />al Rockport Township Lot No. 60, Section 21, as shown <br />by the recorded plat in Volume 30 of Maps, page 4 of <br />Cuyahoga County Records, and bounded and described as <br />follows: Beginning on the Easterly line of Beach <br />Avenue at the Southwesterly corner of said Sublot No. <br />68; thence Northerly along said Easterly line of Beach <br />Avenue 29 2/10 feet to the Northwesterly corner of said <br />Sublot No. 68; thence Easterly along the Northerly line <br />of Sublot No. 68, lO0 feet; thence Southerly parallel <br />with the Easterly line of Beach Avenue to the South- <br />westerly line of s~id Sublot No. 68; thence Northwesterly <br />along the Southwesterly line of said Sublot No. 68, to <br />the place of beginning, be the same more or less, but <br />subject to all legal highways. <br /> <br />and ~o pay therefor the sum of Fifty-Seven Thousand Five Hundred <br />Dollars ($57,500.00). <br /> <br />Section 2. That Title to said premises be evidenced by good and <br />sufficient Warranty Deed with proper release of dower conveying <br />said premises to the City of Lakewood free and clear of all liens <br />and encumbrances, except taxes and assessments not yet due and <br />payable, restrictions of record, if any, and zoning ordinances, <br />provided, however, that Seller shall have the right and option if <br />they so elects to reserve to themselves in said Deed, a <br />terminable estate in the above described premises which shall <br /> <br /> <br />
