ORDINANCE NO. 43-84 BY: Brown, Gallagher, Graham, McBride, Wendl ing AN EMERGENCY ORDINANCE authorizing the Dlrector of Economic and Community Development of the City of Lakewood to purchase certain real estate known as P.P. No. 312-29-069 located at 1301-03 Beach Avenue, in Lakewood, Ohio, hereinafter more particularly described and subject to the terms and conditions hereinafter set forth. WHEREAS, this ordinance constitutes an emergency measure providing 'for the immediate preservation of the public health and welfare and for the usual daily operation of a municipal department and for the further reason that the owners have agreed to sell s~id property for the consideration herein stipulated and this Council determines it to be in the best interest of the City that the property be purchased immediately so that the Clifton Prado Improvement Project can be commenced without any delay; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OH I0: Section 1. That the Director be and he is hereby authorized and directed to purchase from Jimmy D. Wilson, Sr. and Sharon L. Wilson the following property: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio: and known as being part of Sublot No. 68 in The Henry Beach Subdivision of part origin- al Rockport Township Lot No. 60, Section 21, as shown by the recorded plat in Volume 30 of Maps, page 4 of Cuyahoga County Records, and bounded and described as follows: Beginning on the Easterly line of Beach Avenue at the Southwesterly corner of said Sublot No. 68; thence Northerly along said Easterly line of Beach Avenue 29 2/10 feet to the Northwesterly corner of said Sublot No. 68; thence Easterly along the Northerly line of Sublot No. 68, lO0 feet; thence Southerly parallel with the Easterly line of Beach Avenue to the South- westerly line of s~id Sublot No. 68; thence Northwesterly along the Southwesterly line of said Sublot No. 68, to the place of beginning, be the same more or less, but subject to all legal highways. and ~o pay therefor the sum of Fifty-Seven Thousand Five Hundred Dollars ($57,500.00). Section 2. That Title to said premises be evidenced by good and sufficient Warranty Deed with proper release of dower conveying said premises to the City of Lakewood free and clear of all liens and encumbrances, except taxes and assessments not yet due and payable, restrictions of record, if any, and zoning ordinances, provided, however, that Seller shall have the right and option if they so elects to reserve to themselves in said Deed, a terminable estate in the above described premises which shall
