ORDINANCE NO. 44-84 <br /> <br />BY: Brown, Gallagher, Graham, <br /> McBride, Wendling <br /> <br />AN EMERGENCY ORDINANCE authorizing the Director of Economic and <br />Community Development of the City of Lakewood to purchase certain <br />real estate known as P.P. No. 312-29-108 located at 1282 Clifton <br />Prado, in Lakewood, Ohio, hereinafter more particularly <br />described and subject to the terms and conditions hereinafter set <br />forth. <br /> <br />WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health and <br />welfare and for the usual daily operation of a municipal <br />department and for the further reason that the owners have agreed <br />to sell said property for the consideration herein stipulated <br />and this Council determines it to be in the best interest of the <br />City that the property be purchased immediately so that <br />the Clifton Prado Improvement Project can be commenced without <br />any delay; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br />Section 1. That the Director be and he is hereby authorized and <br />directed to purchase from Helen M. Brown the following property. <br /> <br />Ihe subject property is the southerlymost structure on <br />the west side of Clifton Prado adjacent to the railroad <br />tracks. It has a frontage of 72 feet and a depth of 6~ <br />feet containing an area of 4,896 square feet. <br /> <br />and to pay therefor the sum of Nineteen Ihousand Two Hundred <br />Fifty Dollars (.$19,250.00). <br /> <br />Section 2. That Title to said premises be evidenced by good and <br />sufficient Warranty Deed with proper release of dower conveying <br />said premises to the City of Lakewood free and clear of all liens <br />and encumbrances, except taxes and assessments not yet due and <br />payable, restrictions of record, if any, and zoning ordinances, <br />provided, however, that Seller shall have the right and option if <br />she so elects to reserve to herself in said Deed, a termin- <br />able estate in the above described premises which shall terminate <br />either on the date of death of said Seller, or upon the vacation <br />of said premises by said Seller for a period of sixty (60) days <br />or more, or upon mutual agreement of t'he parties whichever date <br />shall be the first to occur. That title to said property shall <br />be subject to the approval of the Director of Law; that real <br />estate taxes and assessments shall be pro rated either as of the <br />date said Warranty Deed is filed for record or date Seller's <br />terminable estate is terminated, whichever date is the latter to <br />occur, using the last available tax rate and valuation for <br />computing the tax pro rations; that the Director of Finance be <br />and he is hereby authorized to pay the amount set forth in <br />Section i hereof from the 1984 Community Development Block Grant <br />Funds upon deliYery by the Grantor of a good and sufficient <br />Warranty Deed to the City of Lakewood, together with guarantee of <br /> <br /> <br />
