Section 5. That the cost of said improvement to be assessed shall be asses- <br />sed in the manner and the number of installments provided in the resolution, <br />and on the lots and lands abutting and abounding upon said improvement be- <br />tween and including the termini of the improvement, as amended, equalized <br />and adjusted by the Board in its report; and the cost of said improvement <br />shall include the cost of preliminary and other surveys, plans, specifica- <br />tions, profiles and estimates and of printing, serving and publishing no- <br />tices, resolutions and ordinances, the amount of damages resulting from the <br />improvement assessed in favor of any owner of land affected by the im- <br />provement and the interest thereon, the costs incurred in connection with <br />the preparation, levy and collection of the special assessments, the cost <br />of purchasing, appropriating and otherwise acquiring therefor any required <br />real estate or interests therein, expenses of legal services including ob- <br />taining an approving legal opinion, cost of labor and material and interest <br />on bonds and notes issued in anticipation of the levy and collection of the <br />special assessments together with all other necessary expenditures. <br /> <br />Section 6. That the list of estimated assessments as heretofore prepared by <br />the Director of Finance and as amended, equalized and adjusted by the Board <br />in its report be and the same is hereby approved and the assessments so to <br />be levied shall be paid in ten (10) semi--annual installments, with interest <br />on deferred payments at the same rate as shall be borne by the bonds to be <br />issued in anticipation of the collection thereof, provided that the owner <br />of any property to be assessed may, at his option, pay such assessment in <br />cash within thirty (30) days after the passage of the assessing <br />ordinance. <br /> <br />Section 7. That obligations of the City shall be issued, in anticipation <br />of the collection of special assessments by installments and in an amount <br />equal thereto, for the purpose of providing funds to pay the cost of this <br />improvement. <br /> <br />Section 8. That pursuant to Article XIV, Section 16, of the Charter of the <br />City, the Director of Public Works has heretofore certified to this Council <br />that his estimate of the life of the improvement described in Sections 1 <br />and 2 hereof is ten (10) years. <br /> <br />Section 9. That the Director of Public Works be and he is hereby authorized <br />and directed as soon as the funds herefor are available to make and execute <br />a contract for said improvement with the lowest and best bidder after adver- <br />tising according to law. <br /> <br />Section 10. That the Clerk of this Council be and she is hereby directed to <br />deliver to the Auditor of Cuyahoga County a certified copy of this ordin- <br />ance within fifteen (15) days following its passage. <br /> <br />Section ll. That it is found and determined that all formal actions of this <br />Council concerning any relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulting in such formal <br />action were in meetings open to the public in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br /> <br />Section 12. That this ordinance, having been declared to be an emergency <br />measure, shall be in full force and effect from and immediately after its <br />passage and approval by the Mayor. <br /> <br />Approved <br /> <br /> <br />
