ORDINANCE NO: 78-84 By: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the City Engineer to take competitive bids without advertisement and to enter into a contract for the installation of 275 linear feet of sanitary and storm sewer pipe for the Department of Public Works to repair the sanitary and'storm sewers on Carabel Avenue between Madison Avenue and Delaware Avenue. WHEREAS, it has come to the attention of the Division of Engineering, Department of Public Works that a section of the sanitary sewer on Carabel Avenue directly beneath the storm sewer is deteriorated and not functioning, and WHEREAS, temporary measures have been taken which allow sewage and storm water to flow passed this point; but a potentially serious problem exists should the sewer become completely blocked, and WHEREAS, it is essential that the sanitary and storm sewer referred to above be repaired immediately so that homes in the area needing repair and directly south will not be cut off from the main sewer on Madison Avenue, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the City Engineer be and he is hereby authorized and directed to take competitive bids without adver- tising and to enter into a contract for the installation of sanitary and storm sewer pipe for the Department of Public Works to repair the sanitary and storm sewers on Carabel Avenue .between Madison Avenue and Delaware Avenue. Section ~. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this. Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all mem- bers of Council, it shall take effect and. be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
