SUBSTITUTE ORDINANCE <br /> <br /> PLACED ON FIRST READING 9-4-84 <br /> PLACED ON SECOND READING 9-17-84 <br /> <br />ORDINANCE: 87-84 <br /> <br />Brown, Chinnock, Graham, <br />Salmon, Wendl ing <br /> <br /> An Emergency Ordinance to amend Section 1319.03(a) of <br />the Building Code of the Codified Ordinances of the City of <br />Lakewood relating to restrictions on front yard fences. <br /> <br /> WHEREAS, pursuant to the current Building Code, <br />property owners have been prohibited from replacing or erecting <br />attractive decorative fences in front of their homes, and <br /> <br /> WHEREAS, this Council wishes to encourage property <br />owners to rehabilitate their homes and to make architecturally <br />pleasing improvements to their properties, and <br /> <br /> WHEREAS, decorative fences have existed as original <br />architectural accent structures in this "City of Homes", and <br /> <br /> WHEREAS, this Council is of the opinion that such <br />decorative fences should be permitted without having to file an <br />appeal with the Board of Building Standards so long as the <br />erection of the fence does not Constitute a hazard and meets the <br />conditions herein stated, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the immediatae preservation of the public <br />safety and welfare and for the usual daily operations of a <br />municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Section 1319.03(a) of'the Building <br />Code of the Codified Ordinances of the City of Lakewood now <br />reading as follows: <br /> <br />1319.03 REGULATIONS AND RESTRICTIONS <br /> <br />(a) <br /> <br />No fence, wall, building or portion of a building <br />shall be erected, placed or extended above the <br />curb level between a building line and the street <br />line, and no living fence shall be permitted to <br />exceed three feet in height above the curb line <br />provided, however, on corner lots the Building <br />Commissioner may issue a permit for a fence to be <br />erected along the property line abutting the side <br />street to extend from the rear property line to <br />the front building line upon determination by the <br />Chief of Police and the Building Commissioner that <br />such fence does not obstruct the view of traffic <br />or constitute a hazard. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br /> <br />
