improvement of the City shall,'to the extent appropriate to application <br />to the City, apply under this section; provided that: <br /> <br /> (a) The provisions cf the CiTy's Charter, Codified <br />Ordinances, non-codified ordinances or resolutions, and administra- <br />tive rules and actions taken pursuant thereto shall prevail over <br />the general laws cf Ohio. <br /> <br /> (b) Chapter 149~ of the i~io Revised Code shall not be <br />applicable to this sectim~ or the City in its operation of Lakewood <br /> <br /> (c) The Board of Hospital Trustees, with respect to <br />contracts per:aining to Lakewood Hospital, and the Council, with <br />respect to all other, contracts, may determine that the provisions <br />of the general laws of Ohio, currently Sections 153.51 to 153.53, <br />inclusive, Ohio Revised Code,.requiring separate bids for each <br />trade or kind of mechanical labor, employment or business and <br />pertaining to performance bonds and specifications of sureties, <br />shall not apply to the City md its contracts. <br /> <br />Ill.05 Fiscal Officers Certificate <br /> <br /> The provisions of Sections 6, Ii, and 6 of Article VIII of the <br />Cit¥'~ Charter, respecting the Director of Finance's certificate con- <br />cerning the availability of funds, shall apply to contracts of ~he City. <br /> <br /> 111.06 ~en Chapter Is Not Applicable <br /> <br /> This Chapter 111 of the Codified Ordinances shall not apply to <br />contracts and leases entered into in connection with the issuance of <br />indus~rial revenue bonds or other conduit debt issuances where the <br />City's ~axes or other revenues are not obligated to repay principal, <br />interes~ or other charges ~ith respect to the bonds, notes or other debt <br />instruments. <br /> <br /> The A~arding Au:hurl:y, with the approval of the Board of Con- <br />trol or :he approval of the Board of Trustees of Lakewood Hospital ~hen <br />the Adminis:ra~or of Lakewood ~ospital is the A~arding Authori:y, may in <br />lie~ of conforming to the provisions of this Chapter follo~ procedures <br />~hich are required by federal or state la~s or regulationS of federal or <br />state agencies when the contract peruains to projects that are financially <br />assis:ed by gran:s, loans or other forms of financial assistance of coop- <br />era:ion agreemen:s from or ~ith the federal or state governments, or agen- <br />cies thereof. · <br /> <br /> Section 2. It is round'nd determined that all formal actions <br />of this Council concerning and relating to the passage of this ordznance <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and any of its co~ittees that resulted in <br />such formal action, were in ~eetings open to the public, in compliance <br />yith all legal requirements including the City's Charter and Codified <br />Ordinances and Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3.
