1321.07 REVOCATION OR DISAPPROVAL OF LICENSE. <br /> <br />The Building Commissioner may disapprove or revoke any li- <br />cense or renewal thereof issued under the provisions of <br />this Chapter for one or several of the following reasons: <br />(a) . <br />(b) . . . <br />(c) . <br />(d) <br />(e) Upon a determination by the Building Commissioner <br />that the applicant or licensee has engaged in a course of <br />conduct calculated to induce owners and/or tenants of <br />property or their authorized agents, to enter into a <br />contractual relationship for labor and/or materials through <br />misrepresentation of labor costs or that the materials <br />used complied with all applicable ordinances of the city <br />in which such misrepresentation was made. <br /> <br />For the purposes of this paragraph, "course of conduct" is <br />defined as two (2) or more separate instances of misrepre- <br />sentation occurring during any twelve (12) month period. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br /> <br />
