~'ORDINANCE NO. 96-84 BY: Brown, Chinnock, Gallagher, Graham, McBride, Wendling AN EMERGENCY ORDINANCE to amend Section 1323.06 and to supplement Section 1323.07 of the Building Code by enacting new subparagraph (e) relating to the registrati~ of contractors and the revocation of such registration. WHEREAS, it has come to the attention of this Council that there are reportedly contractors wOrking within the City who engage in a continuous course of conduct which amounts to fraud upon the citizens of Lakewood, and WHEREAS, this Council is of the opinion that legislation should be adopted which would prohibit contactors from submitting bids to homeowners with the intention of failing to meet the City's Building Code standards due to the fact that substandard materials are specified in the bid, and WHEREAS, present legislation does not specifically address this fraud- ulent course of conduct being practiced by said contractors, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That existing Section 1323.06 of the Building Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1323.06 REGISTRATION BY BUILDING COMMISSIONER. Upon receipt of a properly completed application form and compliance with Section 1323.03, 1323.04 and 1323.05, the Commissioner shall register the applicant in a journal kept for the purpose, and shall issue to the registrant a Certificate of Registration valid only for the current calendar year. The registration shall expire on December 31, of each year and may be renewed from year to year. shall be and the same is hereby amended to read as follows: 1323.06 REGISTRATION BY BUILDING COMMISSIONER. Contractors registered pursuant to this Section shall war- rant or be presumed to have warranted that all work perform- ed and all materials to be supplied by contract are in com- pliance with all applicable ordinances of the City unless the contractee has actual knowledge of any deficiencies or non-compliance at the time the contract is entered into. Section 2. That Section 1323.07 of the Building Code of the Codified Ordinances of the City of Lakewood is hereby supplemented by enacting new para- graph (e) thereof to read as follows:
