Section 312.31: CIVIL ACTION <br /> <br />a) Other Regulations - Whenever any person, firm, or corporation fails, <br /> neglects or refuses to comply with m~ order of the City Council or <br /> with any provision of this Chapter m~d the orders, rules and regu- <br /> lations, and permits issued hereunder, the City Engineer may in his <br /> discretion institute and maintain in the name of the City of Lakewood <br /> an appropriate action at law or in equity to restrain the execution <br /> in violation of this Chapter. <br /> <br />b) Recovery of Damages - Any industrial user who violates any provision <br /> of 't~is" Chapter-or who has a discharge which causes a deposit, ob- <br /> struction, damage or other impairement to the City's wastewater dis- <br /> posal system shall become liable to the City for any expense, loss, <br /> or damage caused by the violation or discharge. The City Engineer <br /> may add to the user's charges and fees the costs assessed for any <br /> cleaning, repair, or replacement work caused by the violation or <br /> discharge. <br /> <br />Section 913.22: INTERPRETATION <br /> <br />a) The provisions of this Chapter shall be interpreted whenever poss- <br /> ible as being in conformity with applicable Federal, State and Local <br /> Regulations, and with other ordinances that may be adopted from time <br /> to time by the City Council of the City of Lakewood, prescribing addi- <br /> tional terms and conditions for users of the treatment works. If any <br /> section of this Chapter shall be adjudged invalid such invalidity <br /> shall not affect the remaining sections. <br /> <br />Sections 913.99: PENALTY <br /> <br />a) Whoever violates any of the provisions of this Chapter is guilty of <br /> a misdemeanor of the first degree. <br /> <br />b) Each day of violation of any of the provisions of this Chapter con- <br /> stitutes a separate offense. <br /> <br /> Section 2.o It is found and determined that 'all formal actions of this <br />Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such delibera- <br />tions of this Council and of any of its committees that resulted in such <br />formal action, were in meetings open to the public, in compliance with <br />all legal requirements including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3.
