RIGHT OF WAY EASEMENT <br /> <br /> FOR AND IN CONSIDERATION of the benefits to be derived by the Grant- <br />or from the highway improvement easement granted herein, the receipt of which <br />is hereby acknowledged, St. Augustine Academy (hereinafter referred to as <br />"Grantor") does hereby grant and convey unto the City of Lakewood, Ohio, its <br />successors and assigns (hereinafter referred as "Grantee") a perpetual ease- <br />ment for the construction, maintenance, inspection, operation, protection, <br />repair and replacement of a Traffic Signal Loop Detector Device within the <br />following described lands, of which Grantor warrants that it is the owner in <br /> <br />fee simple: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga <br />and State of Ohio and known as being part of original <br />Rockport Township Section No. 22, being bounded and describ- <br />ed as follows: <br /> <br /> Beginning in the northerly line of Lake Avenue, 100 <br />feet wide, at the southeasterly corner of Sublot No. 11 in <br />the Sylvanhurst Extension as shown on the plat recorded in <br />Volume 55, Page 15 of Cuyahoga County Map Records; <br /> <br /> Thence easterly 6.0 feet along the northerly line of <br />Lake Avenue to the westerly edge of an asphalt drive of <br />St. Augustine Academy which is the principal place of <br />beginning of the easement described herein; thence norther- <br />ly 17.0 feet along the westerly edge of said drive; thence <br />easterly 12.0 feet along a line perpendicular to the last <br />described course; thence southerly 17.0 feet along a line <br />parallel with the' westerly edge of said drive to the <br />northerly line of Lake Avenue; thence easterly 12.0 feet <br />along said northerly line to the principal place of beginn- <br />ing of this easement. <br /> <br />In addition thereto, the Grantor hereby grants to the Grantee a fif- <br /> <br />teen (15) foot construction area parallel and adjacent to such right of way <br /> <br />for the purpose of enabling the Grantee to install and maintain the aforesaid <br /> <br />Traffic Signal Loop Detector Device. <br /> <br />All to be in accordance with the drawing and Signal Plan diagram <br /> <br />hereto annexed, marked Exhibit "A" and Exhibit "B" respectively, and made a <br /> <br />part hereof. <br /> <br /> Together with the right of unimpaired access to said Traffic Signal <br /> <br />Loop Detector Device and the right of ingress and egress on, over, and <br /> <br />through the above described land for any and all purposes necessary and <br /> <br />incident to the exercise by Grantee of the rights granted hereunder. <br /> <br />The said Grantor shall have the right to use and enjoy the above de- <br /> <br />scribed land except as the same may be necessary for the purposes herein grant- <br />ed to the said Grantee. Grantor agrees not to build, create, 6r construct <br /> <br />any obstructions, engineering works, or other structures over said Traffic Sig- <br />nal Loop Detector Device, nor permit the same to be done by others.
