RIGHT OF WAY EASEMENT FOR AND IN CONSIDERATION of the benefits to be derived by the Grant- or from the highway improvement easement granted herein, the receipt of which is hereby acknowledged, St. Augustine Academy (hereinafter referred to as "Grantor") does hereby grant and convey unto the City of Lakewood, Ohio, its successors and assigns (hereinafter referred as "Grantee") a perpetual ease- ment for the construction, maintenance, inspection, operation, protection, repair and replacement of a Traffic Signal Loop Detector Device within the following described lands, of which Grantor warrants that it is the owner in fee simple: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being part of original Rockport Township Section No. 22, being bounded and describ- ed as follows: Beginning in the northerly line of Lake Avenue, 100 feet wide, at the southeasterly corner of Sublot No. 11 in the Sylvanhurst Extension as shown on the plat recorded in Volume 55, Page 15 of Cuyahoga County Map Records; Thence easterly 6.0 feet along the northerly line of Lake Avenue to the westerly edge of an asphalt drive of St. Augustine Academy which is the principal place of beginning of the easement described herein; thence norther- ly 17.0 feet along the westerly edge of said drive; thence easterly 12.0 feet along a line perpendicular to the last described course; thence southerly 17.0 feet along a line parallel with the' westerly edge of said drive to the northerly line of Lake Avenue; thence easterly 12.0 feet along said northerly line to the principal place of beginn- ing of this easement. In addition thereto, the Grantor hereby grants to the Grantee a fif- teen (15) foot construction area parallel and adjacent to such right of way for the purpose of enabling the Grantee to install and maintain the aforesaid Traffic Signal Loop Detector Device. All to be in accordance with the drawing and Signal Plan diagram hereto annexed, marked Exhibit "A" and Exhibit "B" respectively, and made a part hereof. Together with the right of unimpaired access to said Traffic Signal Loop Detector Device and the right of ingress and egress on, over, and through the above described land for any and all purposes necessary and incident to the exercise by Grantee of the rights granted hereunder. The said Grantor shall have the right to use and enjoy the above de- scribed land except as the same may be necessary for the purposes herein grant- ed to the said Grantee. Grantor agrees not to build, create, 6r construct any obstructions, engineering works, or other structures over said Traffic Sig- nal Loop Detector Device, nor permit the same to be done by others.
