RIGHT OF WAY EASEMENT FOR AND IN CONSIDERATION of the benefits to De derived by the Grant- or from the highway improvement easement granted herein, the receipt of which is hereby acknowledged, Board of Education of the Lakewood City School Dis- trict (hereinafter referred to as "Grantor") does hereby grant and convey unto the City of Lakewood, Ohio, its successors and assigns (hereinafter referred as "Grantee") a perpetual easement for the construction, maintenance, inspection, operation, protection, repair and replacement of a Traffic Signal Loop Detector Device within the following described lands, of which Grantor warrants that it is the owner in fee simple: SITUATED in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being part of original Rockport Township Section No. 22, being bounded and describ- ed as follows: Beginning in the southerly line of Franklin Boulevard at its intersection with the southerly prolongation of the center line of Robinwood Avenue as shown on the Vocation Plat as part of Robinwood Avenue and recorded in Volume 203, Page 56 of Cuyahoga County Map Records; Thence South 1°10'40'', East 23.0 feet continuing along the southerly prolongation of said center line; thence North 88~49'40'' East, 12.0 feet; thence North l°10'40'' West, 21.86 feet to the southerly line of Franklin Boule- vard; thence westerly 12.05 feet along said southerly line to the place of beginning of this easement. In addition thereto, the Grantor hereby grants to the Grantee a fif- teen (15) foot construction area parallel and adjacent to such right of way for the purpose of enabling the Grantee to install and maintain the aforesaid Traffic Signal Loop Detector Device. All to be in accordance with the drawing and Signal Plan diagram hereto annexed, marked Exhibit "A" and Exhibit "B" respectively, and made a part hereof. Together with the right of unimpaired access to said Traffic Signal Loop Detector Device and the right of ingress and egress on, over, and through the above described land for any and all purposes necessary and incident to the exercise by Grantee of the rights granted hereunder. The said Grantor shall have the right to use and enjoy the above de- scribed lanQ except as the same may be necessary for the purposes herein grant- ed to the said Grantee. Grantor agrees not to build, create, or construct any obstructions, engineering works, or other structures over said Traffic Sig- nal Loop Detector Device, nor permit the same to be done by others.
