RIGHT OF WAY EASEMENT <br /> <br /> FOR AND IN CONSIDERATION of the benefits to De derived by the Grant- <br />or from the highway improvement easement granted herein, the receipt of which <br />is hereby acknowledged, Board of Education of the Lakewood City School Dis- <br />trict (hereinafter referred to as "Grantor") does hereby grant and convey <br />unto the City of Lakewood, Ohio, its successors and assigns (hereinafter <br />referred as "Grantee") a perpetual easement for the construction, maintenance, <br />inspection, operation, protection, repair and replacement of a Traffic Signal <br />Loop Detector Device within the following described lands, of which Grantor <br />warrants that it is the owner in fee simple: <br /> <br /> SITUATED in the City of Lakewood, County of Cuyahoga <br /> and State of Ohio and known as being part of original <br /> Rockport Township Section No. 22, being bounded and describ- <br /> ed as follows: <br /> <br /> Beginning in the southerly line of Franklin Boulevard <br /> at its intersection with the southerly prolongation of the <br /> center line of Robinwood Avenue as shown on the Vocation <br /> Plat as part of Robinwood Avenue and recorded in Volume <br /> 203, Page 56 of Cuyahoga County Map Records; <br /> <br /> Thence South 1°10'40'', East 23.0 feet continuing along <br /> the southerly prolongation of said center line; thence <br /> North 88~49'40'' East, 12.0 feet; thence North l°10'40'' <br /> West, 21.86 feet to the southerly line of Franklin Boule- <br /> vard; thence westerly 12.05 feet along said southerly line <br /> to the place of beginning of this easement. <br /> <br /> In addition thereto, the Grantor hereby grants to the Grantee a fif- <br />teen (15) foot construction area parallel and adjacent to such right of way <br />for the purpose of enabling the Grantee to install and maintain the aforesaid <br />Traffic Signal Loop Detector Device. <br /> <br /> All to be in accordance with the drawing and Signal Plan diagram <br />hereto annexed, marked Exhibit "A" and Exhibit "B" respectively, and made a <br />part hereof. <br /> <br /> Together with the right of unimpaired access to said Traffic Signal <br />Loop Detector Device and the right of ingress and egress on, over, and <br />through the above described land for any and all purposes necessary and <br />incident to the exercise by Grantee of the rights granted hereunder. <br /> <br /> The said Grantor shall have the right to use and enjoy the above de- <br />scribed lanQ except as the same may be necessary for the purposes herein grant- <br />ed to the said Grantee. Grantor agrees not to build, create, or construct <br /> <br />any obstructions, engineering works, or other structures over said Traffic Sig- <br />nal Loop Detector Device, nor permit the same to be done by others. If Gran- <br />tee has to excavate this area in order to repair or replace said Traffic <br /> <br /> <br />
