(f) Any person owning or harboring or having the care of any <br /> vicious dog shall maintain a policy of insurance in an amount <br /> not less than fifty thousand dollars ($50,000)insuring said <br /> person against any claim, loss, damage, or injury to persons <br /> resulting from the acts, whether intentional or unintentional~ <br /> of the vicious dog. Such person shall produce evidence of such <br /> insurance upon the request of the Animal Warden or other law <br /> enforcement agent. <br /> <br />(g) In the event that the Animal Warden or other law enforce, <br />ment agent has probable cause to believe that a vicious dog <br />is being harbored or cared for in violation of Sections <br />505.14(b), 505.14(d}, 505.14(e) or 505.14(f), the Animal Warden <br />or other law enforcement agent may petition a court of compe- <br />tent jurisdiction to order the siezure and impoundment of the <br />vicious dog pending trial In the event that the Animal War- <br />den or other law enforcement agent has probable cause to be- <br />lieve that a vicious dog is being harbored or housed in viola- <br />tion of Section 505.14(c), the Animal Warden or other law en- <br />forcement agent may sieze and impound the vicious dog Pending <br />trial. <br /> <br /> (h) Penalty: <br />(1) Whoever violates this section shall be guilty of a <br />Imisdemeanor of the first degree. Whoever is found guilty of <br />a second offense of violating this section shall be guilty of <br />a misdemeanor of the first degree and shall be fined $1,000.00 <br />which fine shall be mandatory, and shall not be suspended or <br />remitted. <br /> <br /> (2) Any vicious dog which attacks a human being or a- <br />nother domestic animal may be ordered destroyed when in the <br />court's judgment such vicious dog represents a continuing <br />threat of serious harm to human beings or other domestic ani- <br />mals. <br /> <br /> (3) Any person found guilty of violating this section <br />shall pay all expenses, including shelter, food, veterinary <br />expenses for identification or certification of the breed of <br />the animal or boarding and veterinary expenses necessitated <br />by the siezure of any dog for the protection of the~public, <br />and such other expenses as may be required for the destruction <br />of any such dog. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open .meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />SectiOn 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />PRESIDEN1 <br /> <br />Approved~~ <br /> <br />I~,.ERK <br /> <br /> <br />
