.~ ORDINANCE NO. 9-85 BY: Brown~ Gallagher~ Graham, McBride, Wendling AN EMERGENCY ORDINANCE to supplement Chapter 505 of the General Offenses Code of the Codified Ordinances of the City of Lakewood by enacting new Section 505.14 relating to vicious dogs. WHEREAS, unprovoked attacks by vicious dogs on human beings and domestic animals have created a need for an ordinance by which this problem can be control- led, and WHEREAS, this Council has concluded that as a result of attacks on human beings and domestic animals by vicious dogs, as herein defined, in the City of Lakewood, it has become necessary to regulate the ownership, harboring and care of such dogs as provided herein, and WHEREAS, thi s ordi nance constitutes an emergency measure provi di ng for the immediate preservation of the public health, safety and welfare; now, there- fore~ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Codified Ordinances of the City of Lakewood be and the same are hereby supplemented by enacti ng new Secti on 505.14 to read as fol- lows: 505.14 VICIOUS DOGS. (a) As used in this Section, "vicious dogs" shall mean and include: (1) Any dog with a known propensity, tendency or disposi- tion to attack unprovoked, to cause injury or to otherwise~n- danger the safety of human beings or domestic animals; or (2) Any dog whi ch has attacked a human bei ng or domestj c animal without provocation on two or more occasions within a one year period; or (3) Any dog owned or harbored primarily or in part for the purpose öf dog fighting or any dog trained for dog fight- ing. (b) No person owning or harboring or having the care or cus- tody of a vicious dog shall suffer or permit such dog to go unconfined On the premises of such person. A vicious dog is "unconfined II as the term is used in this section if such dog is not securely confined indoors or confined in a securely en- closed and locked pen or a dog run area upon the premi ses of sai d person. Such pen or dog run area must al so have either sides six feet high or a secure top. If the pen or structure has no bottom secured to the sides, the sides must be imbedded into the ground no less than one foot. (c) No person owni ng or harbori ng. or havi ng the care of a vi ci ous dog shall suffer or permi t such dog to go beyond the premises of such person unless such dog is securely muzzled and restrai ned with a chai n havi ng a mi nimurn tensi 1 e strength of three hundred (300) pounds and not exceeding three (3) feet in 1 e"gth. (d) No person shall own or harbor any dog for the purpose of dog fighting, or train, torment~ badger, bait or use any dog for the purpose of causing or encouraging said dog to unprovok- ed attacks upon human beings or domestic animals. (e) No person shall possess with intent to sell, or offer for sale, breed, or buy or attempt to buy within the City any vicious dog.
