(2)(A)If the drug is marihuana and the amount is less <br /> than the bulk amount as defined in Section <br /> 513.01(s)(3) and 30 grams or more, drug abuse is a <br /> misdemeanor of the first degree. <br /> (B)If the drug is marihuana and the amount is less <br /> than 30 grams: <br /> (1) for a first offense, drug abuse is a minor mis- <br /> demeanor; <br /> (2) for a second offense under this subparagraph <br /> (B), drug abuse is a misdemeanor of the first de- <br /> gree; <br /> (3) if the offender has previously been convicted <br /> of a drug abuse offense, drug abuse under this <br /> section is a misdemeanor of the first degree. <br /> <br />(d) <br /> <br />Arrest or conviction for a minor misdemeanor viola- <br />tion of this section does not constitute a criminal <br />record except as it applies to increased penalties <br />for future violation of this section and need not <br />be reported by the person so arrested or convicted <br />in response to any inquiries about the person's cri- <br />minal record, including any inquiries contained in <br />any application for employment, license or other <br />right or privilege, or made in connection with the <br />person's appearance as a witness. <br />(ORC 2925.11) <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law and existing paragraphs (c) and (d) of Section 513.03 are hereby <br />repealed at such time. <br /> <br />Approved'~~7~ <br /> <br /> <br />
