ORDINANCE NO. 12-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGE'NCY ORDINANCE enacting new Section 549.051 of <br />the General Offenses Code of the Codified Ordinances of the City <br />of Lake~ood to prohibit the sale, possession and use of stun <br />guns. <br /> <br /> WHEREAS, certain electronic instruments commonly known <br />as stun guns are specifical-ly designed to immobilize human beings <br />for a substantial period of time, and <br /> <br /> WHEREAS, sufficient scientific data does not exist to <br />determine the immediate and/or post-use, physiological effect on <br />the human body, and <br /> <br /> WHEREAS, in the hands of the general public, including <br />those engaged in criminal activity, the use of stun guns greatly <br />increases the probability of the commission of acts detrimental <br />and injurious to the person and/or property of the residents of <br />this City, and <br /> <br /> WHEREAS, the use of stun guns by unauthorized and <br />untrained persons constitutes a substantial threat to the health, <br />safety and welfare of the general public, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety, and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Chapter 549 of the General Offenses Code <br />of the Codified Ordinances of the City of Lakewood is hereby <br />supplemented by enacting new Section 549.051 to read as follows: <br /> <br />549.051 <br />GUNS. <br /> <br />SALE, POSSESSION AND USE OF STUN <br /> <br /> (a) No person, firm or corporation <br />shall, within the City, sell, offer for sale <br />or have in his or its possession or custody, <br />any stun gun. <br /> <br /> (b) As used in this Section "stun gun" <br />means any electronic instrument, device or <br />thing which produces, emits or discharges any <br />current, pulse, volt or charge of electricity, <br />regardless of voltage, amperage, or frequency, <br />and which is designed or specifically adapted <br />to stun, daze, traumatize, incapacitate, or <br />paralyze a human being. <br /> <br /> (c) This section does not apply to law <br />enforcement officers acting within the scope <br />of their duties. <br /> <br /> (d) Wi~oever violates this section is <br />guilty of a misdemeanor of the first degree. <br /> <br /> <br />
