<br />second Qffense of violating this section <br />shall be guilty of a misdemeanor of the <br />first degree and shall be fined <br />$l,ØØØ.Øø which fine shall be mandatory, <br />and shall not be suspended or remitted. <br /> <br />(2) Any vicious dog which attacks a <br />human being or another dorostic animal <br />may be ordered destroyed when in the <br />court's judgment such vicious dogre- <br />presents a continuing threat of serious <br />harm to human beings or other domestic <br />animals. <br /> <br />(3) Any person found guilty of <br />violating this section shall pay all <br />expenses, including shelter, food, <br />veterinary expenses for identification <br />or certification of the breed of the <br />animal or boarding and veterinary <br />expenses necessitated by the siezure of <br />any dog for the protection of the <br />pUblic, and such other expeses as may be <br />required for the destruction of any such <br />dog. <br /> <br />505.18 CERTAIN ANIMALS PROHIBITED. <br /> <br />(a) No person sháll knowingly keep, maintain <br />or have in his possession or under his control <br />'within the City any dangerous or carnivorous <br />wild animal or reptile, any vicious or <br />dangerous domesticated animal, or any other <br />animal or reptile or wild, vicious or <br />dangerous propensities, except to the extent <br />that an exemption may be applicable pursuant <br />to paragraphs (c) or (d), below. <br /> <br />(b) For the purposes of this Section, there <br />shall be an irrebuttable presumption that, <br />when kept or maintained within the City of <br />Lakewood, the animals listed below are <br />considered dangerous animals to which the <br />prohibi tion of paragraph (a), in the absence <br />of an exemption pursuant to paragraphs (c) or <br />(d) below, applies: <br /> <br />1) All crotalid, elapid and venomous <br />colubroid snakes; <br />2) Apes; Chimpanzees (Pan); gibbons <br />(hylobates); gorillas (Gorilla); <br />organutans (pongo); and siamags <br />(Symphalangus); <br />3) Baboons (Papoi, Manrillus); <br />4) Bears (Ursidae); <br />5) Bison (Bison); <br />6) Cheetahs (Acinonyx jubatus); <br />7) Crocodilians (Ctocodilia) when <br />seventy-two (72) inches in length or <br />more; <br />8) Constrictor snakes when fourteen <br />(14) fee-t in length or more; <br />9) Coyotes (Canislatrans); <br />lØ) Deer (Cervidae), includes all <br />members of the deer family, for example, <br />white-tailed deer, elk, antelope ahd <br />moose; <br /> <br />10 <br />
