<br />505·09 CRUELTY TO ANIMALS <br /> <br />(a) No person shall: <br /> <br />(1) <br /> <br />Torture an animal, deprive one of <br />necessary sustenance, unnecessarily <br />or cruelly beat, needlessly muti- <br />late or kill, or impound or confine <br />an animal without supplying it <br />during such confinement with a <br />sufficient quantity of good }'íhole- <br />some food and water; <br />Impound or confine an animal <br />without affording it, during such <br />confinement, access to shelter from <br />wind, rain, snow or excessive di- <br />rect; sunlight if it can reasonably <br />be expected that the anim.al would <br />otherwise become sick or in some <br />other way suffer, or confine such <br />animal in an automobile or other <br />vehicle without proper ventilation. <br />This subsection (a)(2) does not <br />apply to animals impounded or con- <br />fined prior to slaughter. For the <br />purpose of this section, "shelter!! <br />means a man-made enclos'ure, <br />windbreak, sunshade or natural <br />windbreak or sunshade that is de- <br />veloped from the earth's contour, <br />tree development or vegetation; <br />Carry or convey an animal in a <br />cruel or inhuman manner; <br />Keep animals other than cattle, <br />po~ltry or fowl, swine, sheep or <br />goats in an enclosure without <br />wholesome exercise and change of <br />air. <br /> <br />(2) <br /> <br />(3) <br />(4) <br /> <br />(b) Whoever violates this section is guilty <br />of a misdemeanor of the second degree. (ORC <br />959.99 (d)) <br /> <br />505·10 PROPER MAINTENANCE OF ANIMAL YARD <br />STRUCTURES AND PENS REQUIRED. <br /> <br />(a) It shall be unlawful for any person to <br />keep or maintain any animal or fowl in any <br />yard structure or area that is not clean, dry <br />and sanitary; free from debris and offensive <br />odors that annöy any neighbor; and devoid of <br />rodents and vermin. <br /> <br />(b) All' animal pens and yards shall be so <br />located that adequate drainage is obtained, <br />normal drying occurs, and standing water is <br />not present. <br /> <br />(c) All premises other than private residen- <br />ces on which animals are kept shall be subject <br />to inspection by the Health Officer and/or the <br />Supervisor. If the Health Officer or the <br />Supervisor determines from such inspection <br />that the premises are not being maintained in <br />a clean and sanitary manner, he shall notify <br />the owner of the animal in writing to correct <br /> <br />5 <br />
