ORDINANCE NO: 26-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer <br />to advertise for bids and the Public Works Director to enter <br />into a contract with the lowest and best bidder after <br />advertisement according to law for the installation of a new <br />water main on Cook Avenue between Detroit Avenue and Clifton <br />Boulevard in the City of Lakewood. <br /> <br /> WHEREAS, Council has determined that the water main <br />on Cook Avenue between Detroit Avenue and Clifton Boulevard <br />is badly deteriorated and in urgent need of replacement, and <br /> <br /> WHEREAS, this Council has authorized the preparation <br />of construction drawings and specifications by the Lakewood <br />Engineering Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings <br />and specifications are now on file in the City Engineer's <br />office, and <br /> <br /> WHEREAS, this Ordinance constitutes an~ emergency <br />measure providing for the usual daily operation of a municipal <br />department and for the immediate preservation of the public <br />safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL. OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Sesction 1. That the City Engineer be and he is <br />hereby authorized and directed to advertise for bids and the <br />Public Works Director to enter into a contract with the lowest <br />and best bidder after advertisement according to law for the <br />installation of a new water main on Cook Avenue between Detroit <br />Avenue and Clifton Boulevard in the City of Lakewood. <br /> <br /> Section 2. That the cost of such construction is <br />estimated at $200,000, which funds are to be made available <br />from the Community Development Block Grant Fund. <br /> <br /> Section 3. It is found and determined that all <br />formal actions of this Council concerning and relating to <br />the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in 'compliance <br />with all legal requirements including Section 121.22 of the <br />Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect <br />and be in force after the earliest period allowed by law. <br /> <br />Adopted: ~ ]r~tq~'" <br /> <br /> <br />
