ORDINANCE NO: 27-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer <br />to advertise for bids and the Public Works Director to enter <br />into a contract with the lowest and best bidder after <br />advertisement according to law for the installation of new <br />service connections and hydrants on McKinley Avenue between <br />the South Marginal and Riverside Drive in the City of Lakewood. <br /> <br /> WHEREAS, Council has determined the existing 6-inch <br />water main on McKinley Avenue between the South Marginal and <br />Riverside Drive is badly deteriorated, and <br /> <br /> WHEREAS, Council has determined abandonment of the <br />existing 6-inch water main will necessitate the installation <br />of new service connections and hydrants from an existing 12-inch <br />water main, and <br /> <br /> WHEREAS, this Council has authorized the preparation <br />of construction drawings and specifications by the Lakewood <br />Engineering Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings <br />and specifications are now on file in the City Engineer's <br />office, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department and for the immediate preservation of the public <br />safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br /> STATE OF OHIO: <br /> <br /> Sesction 1. That the City Engineer be and he is <br /> hereby authorized and directed to advertise for bids and the <br /> Public Works Director to enter into a contract with the lowest <br /> and best bidder after advertisement according to law for the <br /> installation of new service connections and hydrants on McKinley <br /> Avenue between the South Marginal and Riverside Drive in the <br /> City of Lakewood. <br /> <br /> Section 2. That the cost of such construction is <br /> estimated at $25,000, which funds are to be made available <br /> from the Water Fund (as a result of a note issued). <br /> <br /> Section 3. It is found and determined that all <br /> formal actions of this Council concerning and relating to <br /> the passage of this ordinance were adopted in an open meeting <br /> of this Council, and that all such deliberations of this Council <br /> and of any of its committees that resulted in such formal <br /> action, were in meetings open to the public, in compliance <br /> with all legal requirements including Section 121.22 of the <br /> Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared <br /> to be an emergency measure for the reasons stated in the <br /> preamble hereof and provided it receives the affirmative vote <br /> of two-thirds of all members elected to Council, it shall <br /> take effect and be in force immediately upon its adoption <br /> and approval by the Mayor; otherwise it shall take effect <br /> and be in force after the earliest period allowed by law. <br /> <br /> Adopted <br /> <br /> <br />
