ORDINANCE NO. 28-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Mayor to engage special consultants to assist the Lakewood Citi- <br />zen Cable Advisory Committee in evaluating the request of Cox <br />Cable Cleveland Area, Inc. for a renewal of its City of Lakewood <br />cable franchise and make recommendations in connection therewith. <br /> <br /> WHEREAS, Cox Cable Cleveland Area, Inc. has filed an <br />application with the City for a renewal of its cable franchise, <br />and <br /> <br /> WHEREAS, this Council has appointed a Lakewood Citizens <br />Cable Advisory Committee to obtain public input as required by <br />law and to otherwise evaluate and make recommendations in connec- <br />tion with any renewal of said cable franchise, and <br /> <br /> WHEREAS, the appointed committee feels that consultants <br />could provide a valuable resource and would be beneficial to the <br />entire process being undertaken by the Committee, and <br /> <br /> WHEREAS, this Council determines that the employment of <br />consultants would be in the best interest of the City and that <br />Messers. Gary Previts and Michael J. Zofchak, 16516 Timberline <br />Drive, Strongsville, Ohio, are adequately qualified to discharge <br />said task, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />welfare and for the further reason that such consultants should <br />be retained at the earliest possible time; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF 0HIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br />authorized and directed to engage Messers. Gary Previtz and <br />Michael J. Zofchak, 16516 Timberline Drive, Strongsville, Ohio, <br />44136, as consultants to assist the Lakewood Citizen Cable <br />Advisory Committee in evaluating the request of Cox Cable <br />Cleveland Area, Inc. for a renewal of its cable franchise. <br /> <br /> Section 2. That the fees for such consultants shall not <br />exceed the sum of Four Thousand Two Hundred ($4,200.00) Dollars <br />and same is hereby appropriated and shall be paid from the <br />General Fund-Legislative Department.. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of 'this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br />and be in force immediately upon its adoption and approval by the <br /> <br /> <br />
