ORDINANCE NO. 28-85 BY: Brown, Chinnock, Gallagher, Graham, McBride, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor to engage special consultants to assist the Lakewood Citi- zen Cable Advisory Committee in evaluating the request of Cox Cable Cleveland Area, Inc. for a renewal of its City of Lakewood cable franchise and make recommendations in connection therewith. WHEREAS, Cox Cable Cleveland Area, Inc. has filed an application with the City for a renewal of its cable franchise, and WHEREAS, this Council has appointed a Lakewood Citizens Cable Advisory Committee to obtain public input as required by law and to otherwise evaluate and make recommendations in connec- tion with any renewal of said cable franchise, and WHEREAS, the appointed committee feels that consultants could provide a valuable resource and would be beneficial to the entire process being undertaken by the Committee, and WHEREAS, this Council determines that the employment of consultants would be in the best interest of the City and that Messers. Gary Previts and Michael J. Zofchak, 16516 Timberline Drive, Strongsville, Ohio, are adequately qualified to discharge said task, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public welfare and for the further reason that such consultants should be retained at the earliest possible time; now, therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF 0HIO: Section 1. That the Mayor be and he is hereby authorized and directed to engage Messers. Gary Previtz and Michael J. Zofchak, 16516 Timberline Drive, Strongsville, Ohio, 44136, as consultants to assist the Lakewood Citizen Cable Advisory Committee in evaluating the request of Cox Cable Cleveland Area, Inc. for a renewal of its cable franchise. Section 2. That the fees for such consultants shall not exceed the sum of Four Thousand Two Hundred ($4,200.00) Dollars and same is hereby appropriated and shall be paid from the General Fund-Legislative Department.. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of 'this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the
