<br />SECTION 129.08. DEFINITIONS. <br /> <br />As used in Sections 129.08 to 129.12, inclu"" <br />sive, of the Codified Ordinances, unless another <br />definition is provided or the content otherwise <br />requires: <br /> <br />(a) "Active Deposit" means a deposit of the <br />City's Public Moneys payable or withdrawable, in <br />whole or in part, on demand. or a deposit in a <br />negotiable order of withdrawal account as authorized <br />in the Consumer Checking Account Equity Act of 1980, <br />94 Stat. 146, 12 U.S.C.A. 1832(a). <br /> <br />(b) "Eligible Depository" or "Eligible Deposi- <br />tories" means any institution mentioned in Section <br />135.03, Ohio Revised Code, that has an office <br />situated within Cuyahoga County, Ohio, whose <br />accounts are insured by the federal government or <br />agency or instrumentality thereof. <br /> <br />(c) "Public Moneys" means ail moneys in the <br />treasury of the City or moneys coming lawfully into <br />the possession of the City's Director of Finance. <br /> <br />(d) "Uniform Depository Act" means Chapter 135 <br />of the Revised Code of Ohio and any amendment or <br />supplement thereto. Wherever any provision of the <br />Uniform Depository Act is made applicable under this <br />Chapter 129 of the Codified Ordinances, such provi- <br />sions are applicable only to the extent that they <br />are not in conflict with or inconsistent with the <br />City's Charter and ordinances or resolutions. <br /> <br />SECTION 129.09. FINDINGS ~Y THE COUNCIL: INAPPLI- <br />CABILITY OF AND INCORPORATION OF <br />STATE LAWS <br /> <br />(a) The Council hereby makes the following <br />findings with respect to the authorization and the <br />establishment of the policies and procedures for the <br />deposit and investment of Public Moneys in the <br />City's treasury: <br /> <br />(1) The authorization and establishment of <br />such policies and procedures are powers of <br />local self-government that may be exer- <br />cised by the City through its ordinances <br />under Sections 3 and 7 of Article XVIII of <br />the Ohio Constitution and Article I of the <br />City's Charter; and <br /> <br />(2) The authorization and establishment of <br />such policies and procedures are in the <br />best interests of the City and its citi- <br />zens: (i) to provide a more efficient <br />management of the City's moneys and in- <br />vestments; and (ii) to enable the City to <br />earn a greater yield on its investments <br /> <br />-2- <br />
