<br />ORDINANCE NO. 45-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br />Graham, McBride, Salmon, Wendlin <br /> <br />AN EMERGENGY ORDINANCE to supplement Chapter 1325 of <br />the Building Code of the Codified Ordinances of the City of <br />Lakewood by enacting new Section 1325.06 to provide for notice to <br />abutting property owners of all matters to come before the Archi- <br />tectural Board of Review. <br /> <br />WHEREAS, it has come to the attention of this Council <br />that complaints have been received from citizens of the community <br />as to the lack of notice of matters to come before the <br />Architectural Board of Review, and <br /> <br />WHEREAS, it is the public's right to know <br />before all boards and commissions of the City <br />concerning matters pending before such boards and <br />and <br /> <br />and to appear <br />to be heard <br />commissions, <br /> <br />WHEREAS, thia ordinance constitutes an <br />measure providing for the immediate preservation of <br />safety and welfare and for the usual operation of a <br />department; now, therefore, <br /> <br />emergency <br />the public <br />municipal <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br />Section 1. That Chapter 1325 of the Building Code of <br />the Codified Ordinances of the City of Lakewood shall be and the <br />same is hereby supplemented by enacting new Section 1325.06 to <br />read as follows: <br /> <br />1325.06 NOTICE OF HEARINGS. <br /> <br />(a) Notice of all matters to come <br />before the Board for review shall be given to <br />all owners and tenant occupants of all <br />property any part of which abuts upon any <br />part of the parcel of land described in the <br />docket item. <br /> <br />(b) The notice referred to hereinabove <br />shall be given by First Class Mail with <br />postage prepaid, which notice shall be mailed <br />by the Secretary of the Board at least four <br />days before the date of such meeting. <br /> <br />(c) In the case of an apartment <br />building or a multiple use building, in lieu <br />of notice by mail to each tenant in the <br />building¡ notice may be posted in a general <br />public use area of the building. <br /> <br />Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all suðh deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br />bean <br /> <br />Section 3.
