filed with the Department. Any equipment purchased'with the funds provided by the Department shall remain the property of the Department. Grantee shall, when awarding subcontracts, give preference wherever possible to Ohio vendors and contractors in the purchase or acquisition of goods or sevices. ARTICLE VIII: MODIFICATIONS OF AGREEMENT When the program to be developed under this Agreement varies to any material extend from that described in the proposal and the budget therein, or when the transfer of funds among program activities or cost categories will exceed ten percent (10%) of the total amount of the Agreement award, Grantee shall submit a written Agreement Modification request to the Department. The request shall contain a narrative explanation of the proposed changes or transfers, and set forth the reasons for such changes or transfers. Such changes or transfers shall not be effective unless approved within thirty (30) days of receipt of such request by the Department. If Grantee willfully and intentionally does not inform the Department of such changes or transfers, the Department shall have the right to refuse to honor any requests for payment or invoices submitted by Grantee for program costs incurred or paid after such changes or transfes have taken place. The Department shall be entitled to recover any amounts disbursed to Grantee for program costs incurred after such changes or transfers. ARTICLE IX: EQUAL EMPLOYMENT OPPORTUNITY The Grantee will not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, handicap or age. The Grantee will take affirmative action to ensure that applicants are employed, and that employees are treated during employment without regard to their race, religion, color, sex, national origin, handicap or age. Such action shall include but not be limited to the following: Employment, Upgrading, Demotion, or Transfer; Recruitment or Recruitment Advertisement; Layoff or Termination; Rates of Pay or other Forms of Compensation; and Selection for Training, including Apprenticeship. The Grantee agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this non-discrmination clause. The Grantee will, in all solicitations or advertisements for employees placed by or on behalf of the Grantee state that all qualified applicants will receive consideration for employment without regard to race, color, sex, religion, national origin, handicap or age. The Grantee will incorporate the foregoing requirements of this paragraph in all of its contracts for any of the work prescribed herein (other than subcontracts for standard commercial supplies or raw materials}, and will require all of its subcontractors for any part of such work to incorporate such requirements in all subcontracts for such work.
