ORDINANCE NO. <br /> <br />74-85 <br /> <br />BY: Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on <br />behalf of the City of Lakewood to accept a deed from the Lakewood <br />Historical Society, a non-profit corporation, transferring an <br />undivided one-half interest in the property located at 13335 <br />Detroit Avenue, Lakewood, Ohio, now known as the Nicholson <br />Homestead, to the City. <br /> <br /> WHEREAS, pursuant to ordinance 30-85 adopted on May 6, <br />1985, the City purchased jointly with the Lakewood Historical <br />Society the property located at 13335 Detroit Avenue, Lakewood, <br />Ohio, known as the Nicholson Homestead, and <br /> <br /> WHEREAS, the Nicholson Homestead has been designated a <br />historical landmark and it is the intention of the Lakewood <br />Historical Society and the City to restore and preserve said <br />Homestead for future community use, and <br /> <br /> WHEREAS, this Council determines that rather than joint <br />ownership, the restoration and preserw~tion can more efficiently <br />be effected by having the City own the Homestead outright and <br />lease same to the Lakewood Historical Society who would in effect <br />manage the propertyw and <br /> <br /> WHEREAS, this Council detemines that it is in the best <br />interest of the City to accept from the Lakewood Historical <br />Society its deed for an undivided one-half interest, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br />authorized to accept a deed from the Lakewood Historical Society, <br />a non-profit corporation, transferring to the City of Lakewood an <br />undivided one-half interest to the property located at 13335 <br />Detroit Avenue, Lakewood, Ohio, known as the Nicholson Homestead, <br />said deed to be substantially in the form of Exhibit "A" <br />attached hereto and made a part hereof as if fully rewritten <br />herein. <br /> <br /> Section 2. That the Director of Law is hereby <br />authorized and directed to cause said quitclaim deed to be filed <br />and recorded for record with the Recorder of Deeds and Records of <br />Cuyahoga County. <br /> <br /> ~ Section 3. It is found and determined that all formal <br />action's of this Council concerning and .relating to the passage of <br />this ordinance were adopted in an open meeting of this Council,. <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br /> <br />1 <br /> <br /> <br />
