ORDINANCE NO. 75-85 <br /> <br />BY: Gallagher, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Mayor to enter into a lease agreement with the Lakewood <br />Historical Society for the use, maintenance, renovation, <br />management and operation of the Nicholson Homestead located at <br />13335 Detroit Avenue, Lakewood, Ohio. <br /> WHEREAS, the City is the owner of the property located <br />at 13335 Detroit Avenue, Lakewood, Ohio, known as the Nicholson <br />Homestead which Homestead has been designated a historical <br />landmark, and <br /> WHEREAS, said premises were acquired to preserve a <br /> historic structure and to expand knowledge of the history, <br /> traditions and heritage of the City of Lakewood under the <br /> auspices of the Lakewood Historical Society, a non-profit <br /> corporation, and <br /> WHEREAS, it is in the best interest of the City to <br /> eventually restore the building on the premises as a historical <br /> landmark which would be best operated by the Lakewood Historical <br /> Society, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br /> measure providing for the usual daily operation of a municipal <br /> department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br /> STATE OF OHIO: <br /> Section 1. That Council hereby determines that the <br /> property located 13335 Detroit Avenue, Lakewood, Ohio, known as <br /> the Nicholson Homestead should be leased to the Lakewood <br /> Historical Society, a non-profit corporation, and that said lease <br /> is in the best interest of the City and will further the interest <br /> of the City and its residents. <br /> Section 2. That the Mayor be and he is hereby <br /> authorized and directed to enter into a lease agreement with the <br /> Lakewood Historical Society, a non-profit corporation, providing <br /> for the use, maintenance, renovation, management and operation of <br /> the Nicholson Homstead located at 13335 Detroit Avenue, Lakewood, <br /> Ohio, said agreement to be substantially in the form of Exhibit <br /> "A" attached hereto and made a part hereof as if fully rewritten <br /> herein. <br /> Section 3. It is found and determined that all formal <br /> actions of this Council concerning and irelating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, <br /> and that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action, were in meetings <br /> '~ open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> Section 4. That this ordinance is hereby declared to <br /> be an emergency measure for the reasons .stated in the preamble <br /> hereof and provided it receives the affirmative vote of two- <br /> <br /> <br />
